On February 26, 2022 at 1840 hours, Lt. Brown and I were dispatched to 5240 GA-196 (Shuman’s) in reference to a crash.

While Lt. Brown spoke to William Ross, he smelled the odor of an alcoholic beverage admitting from his breath. Mr. Ross was the driver of vehicle 2. Lt. Brown asked if I would conduct field sobriety on the driver and make sure he can operate a vehicle safely.

I asked the driver about where he was coming from and he said Food Lion. I asked him about how much he had to drink (alcoholic beverages) and he said one 24 oz Bud Ice about one hour before driving. I asked him if he would submit to field sobriety tests and he said yes.

Lighting conditions consisted of my flashlight, headlights, and street lights. The exercise surface was flat, smooth, and dry. The driver stated he did not wear glass. Each exercise was explained and demonstrated to the driver and when asked if he understood, he gave a verbal yes. The walk and turn and the one leg stand was not done due him having a injured right knee.

Horizontal Gaze Nystagmus
1) Lack of smooth pursuit in both eyes
2) Nystagmus at maximum deviation in both eyes

Lack of Convergence
1) But eyes did not cross.

1) Eyelid tremors
2) Swaying

The driver was placed under arrest for driving under the influence of alcohol. The driver was placed in double-locked handcuffs which were checked for fit. He was searched incident to arrest and no contraband was found. He was placed in the rear seat of my patrol vehicle for transport. My patrol vehicle was searched after my last transport and no contraband was found. I read the Georgia implied consent notice for suspects under age of 21, from my green implied consent card on scene. Mr. Ross gave a verbal yes for breath.

Mr. Ross was transported to the Hinesville Police Department where Lt. Dill administered the Intoxilyzer 9000. He gave two breath samples (.106 grams and .104 grams). He was then transported to the Liberty County Detention Center for further processing. I searched the rear seat of my patrol vehicle after transport and no contraband was found. Mr. Ross was cited for driving under the influence of alcohol, and driving while license suspended.
