On Wednesday, 01/17/2024, I, Deputy L. Hammack (#727) was dispatched to [1100 BLOCK] Burnt Stand Rd, Dawsonville Ga 30534 (District 4), in reference to animal cruelty.
Upon arrival I met with the male who had shot the dogs. He advised me that they have had an on going issue with their neighbors dogs getting into their trash. He advised that he came home and noticed the dogs getting into the trash. He then got out of his vehicle and shot both dogs. The males wife was inside their residence at the time. The males stepson was outside with him at the time of the shooting.
I then went to go speak to the complainant. She was sitting in her drive way holding the already deceased dog. The complainant was grieving profusely. There was a male friend with the complainant who claimed that the male that shot the dog also pointed the gun at him in a threatening manner. The complainant, and her friend then went into the woods to search for the other dog.
Sergeant de Klerk (#735), and [REDACTED] with Animal Control then arrived on scene. [REDACTED] then spoke with the male and explained to him that dogs getting into their trash was not a justified reason to shoot the dogs. The male then explained the area he was standing when he shot the dog. He explained that he was standing at the front of my car where it was parked and shot them. At the front of my patrol vehicle there where five 9mm shell casings. The male also explained that the firearm was placed in a safe before our arrival.
[REDACTED] with Animal Control took pictures of the area, and the deceased dog. I asked the male who shot the dogs to fill out a voluntary statement form and he declined. I then went and asked the lady who was holding the dog if she would like to press charges. She said yes. I was then informed that the dog belongs to her daughter. The daughter was not on scene at the time. However, I spoke to her on the phone and she informed me that she would like to press charges.
While talking to the male that shot the dogs he informed me that he did not point his firearm at the complainants friend. I informed the complainants friend that I would send the case to investigations to look into further. At this time both parties had conflicting statements. We then charged the male who had shot the dog with 16-12-4 Aggravated Cruelty to Animals. This male did knowingly and willingly maliciously cause the death of an animal. The male was placed under arrest. He was cuffed in the back. Handcuffs were sized and double locked.
Sargeant de Klerk searched the male for any weapons or contraband. He was then placed in the back of Sgt. de Klerk’s vehicle. He was then transported to the Lumpkin County Detention Center by Sgt. de Klerk. I then had a voluntary statement form filled out by the complainant’s friend. I also criminally trespassed the male from the other males property by the request of the wife. Both parties accused the other of making terroristic threats. As I was leaving the daughter and owner of the dog arrived on scene. I was requested to trespass her as well from their property.
Upon their arrival the daughters boyfriend got out of the vehicle and shouted along the lines “You piece of sh*t!”. I advised all parties to separate and not to have any contact with each other. I then left the scene. I was then called back to the scene later that day. I was informed by the wife that the complainant was trespassing on her property. I did not witness the complainant on her property and informed the wife to send me all pictures and video evidence to my county email.
Sgt. de Klerk then spoke to all parties again to calm the situation. The wife informed us that she was planning on getting a hotel room for the night. Due to the male being in custody, and the wife not having access to the gun safe the firearm was not collected on scene.
