On September 7th, 2022 at 2135 hours I, Deputy P. Hunt was dispatched to [3400 BLOCK] Della Slaton Road for a possible dispute. The caller was identified as a Mr. [WITNESS #1]. He advised dispatch that his daughter identified as a Ms. [WITNESS #2] was at [3400 BLOCK] (her residence). He stated that [WITNESS #2] and a male by the name of Coleman Patton had gotten into an argument and Coleman had shot [WITNESS #2]’s dog, and fled into the woods.
I arrived on scene and met with [WITNESS #2] at her residence. Upon entry into the residence I saw blood droplets all over on the floor. I then saw a gray pitbull with and entry wound to its right side and an exit wound on its right side near the butt hole area. I asked [WITNESS #2] what had happened. [WITNESS #2] stated that her, Coleman and the dog were in the roadway (Della Slaton Rd.) at around 1930 hours this date. [WITNESS #2] and Coleman were verbally arguing. Coleman had a handgun in his hand during this time. The dog was starting to bite at Coleman on the arm due to the two humans arguing.
Coleman yelled at [WITNESS #2] that he was going to shoot her dog. Coleman then swung at the dog with the hand he had the handgun in. The handgun then discharge and hit the dog in the aforementioned area of the dogs body. This all occured in the middle of Della Slaton Rd.. [WITNESS #2] then grabbed the handgun from Coleman. Coleman then fled the scene. [WITNESS #2] took the handgun to her uncles residence next door. The uncle was identified as a Mr. [WITNESS #3]. [WITNESS #2] called [WITNESS #3] for me and had him bring me the handgun at the incident location.
[WITNESS #2] showed me the area in the roadway where the incident took place. I saw blood droplets and blood smeared on the yellow line of Della Slaton rd. and in both lanes of travel in front of her residence. I took photographs of the dogs injuries, the blood in the trailer and the blood in the roadway. The pictures were submitted via evidence.com.
[WITNESS #3] arrived on scene and handed me a Smith and Wesson S&W 40 gray and black handgun. I was unable to get a serial number off of the handgun due to a laser covering the serial number, and no way to remove the laser. The handgun had a magazine with 13.40 bullets inside of it. [WITNESS #3] advised me that around 1930 hours [WITNESS #2] had brought him the handgun and told him what had happened. The handgun, magazine and bullets were seized as evidence and placed into property box #11.
During this time I had dispatch run a criminal history on Coleman. They advised me that he was a convicted Felon in the State of Georgia. Coleman was charged and adjucated for the Felony offense of Burglary 1st degree of July 2017 in Madison County Georgia. Based upon the evidence presented to me by [WITNESS #2]’s testimony, and the physical evidence on scene. I had probable cause for the arrest of Coleman for the following offenses:
1 Possesion of a firearm by a convicted Felon
1 Reckles conduct (Shooting in the middle of a roadway and close to nearby residences, and next to [WITNESS #2])
1 Discharging a Firearm from a roadway
1 Animal Cruelty
Coleman wasn’t located while we were on scene at the incident location.
While I was enroute from the scene to the Sheriffs Office to secure the handgun, and seek the warrants for the aforementioned criminal charges, Lt. J. Ring was flagged down by [WITNESS #2] and was advised that Coleman was at his mothers residence at [4600 BLOCK] Comer Paoli Road. Cpl. Shubert and I went to the location.
Cpl. Shubert went to the front door and I went to the back door due to Colemans history of obstruction of leos. A few moments later Cpl. Shubert advised me over the radio that he had Coleman in custody for my charges. I went inside the trailer, and saw Coleman standing with Cpl. Shubert in handcuffs. I escorted Coleman to the front porch area, and had him set down in a swing. I read him his miranda rights from my miranda card. He agreed to talk to me and waive his rights.
I advised Coleman of the Charges that I was charging him with. When asked what happened over on Della Slaton Rd. Coleman stated that he wasn’t over there. When asked about [WITNESS #2] he stated he didn’t know a [WITNESS #2]. Cpl. Shubert talked to the mother of Coleman ([REDACTED]) and advised her what was going on. Eventually Coleman admitted to being on Della Slaton Rd. and having an argument with [WITNESS #2]. He stated that she was the one with the gun and not him. I placed Coleman into the backseat of my patrol car.
Cpl. Shubert advised me that the handgun that I had recovered was possibly Coleman’s mother’s handgun. She had just looked for her gray and black Smith and Wesson handgun and it was missing. She had last seen the handgun 4 days prior to today. I went and retrieved the handgun and showed it to [REDACTED]. She stated that yes that was her handgun that I had recovered. She was advised that it was being seized as evidence, and she could get it back once it was no longer needed.
I transported Coleman to the Madison County Jail and turned him over to the jail staff. The handgun and ammunition were secured in property box #11 for evidence in this case and a property receipt was filled out for the items. I will be seeking warrants for the aforementioned charges listed above. I went back into service. The backseat of my patrol car was searched prior to and after this transport.
