On October 9, 2025 deputies were dispatched to [1700 BLOCK] Della Slaton Road in reference to a domestic dispute with injuries to an elderly male. The suspect was still on scene at the time of call. EMS was also dispatched and advised to stage due to the elderly male having multiple injuries that were bleeding.

Upon arrival I made contact with the caller [WITNESS #1] outside the residence. He stated his brother James “Lee” Huth assaulted his father [VICTIM #1], by slapping him in the face with an open hand then punching him in the face as well following an argument. I have had history with Lee at this residence and know he consumes alcohol, I asked [WITNESS #1] if Lee was under the influence of alcohol. [WITNESS #1] replied Lee was intoxicated. Lee then picked up a short black metal pipe raising it in the air as if he was going to swing and hit his father.

When [WITNESS #1] seen Lee with the pipe he went and got a fishing pole and hit Lee with it trying to defend his father. [WITNESS #1] retrieved the fishing pole from the back yard while the fight took place on the front porch, when he returned back to the front of the residence he noticed [VICTIM #1] was laying on the porch and Lee was over him. Lee then threw the metal pipe towards [WITNESS #1] in the yard.

This was all witnessed by [WITNESS #2] who was also out front of the residence. [WITNESS #2] advised me he seen Lee hit [VICTIM #1] in the face and throw the metal pipe. [WITNESS #2] was able to show me where Lee picked up the pipe taking it inside and putting it on the counter in the kitchen.

I was able to make contact with Lee inside the residence while he was sitting on the couch drinking an alcoholic beverage. Lee attitude was very excited and agitated with slurred speech which is common when he is under the influence. Lee stated he began arguing with [WITNESS #1] and [VICTIM #1] due to they were “robbing him”. [VICTIM #1] stated during the argument [WITNESS #1] hit him with a fishing pole on the arms. [VICTIM #1] tried pointing out a few spots on his arms he stated came from the fishing pole, I did not observe anything consistent with being hit.

I advised EMS they were clear to come in while I was speaking with Lee. [VICTIM #1] was still outside the residence in the back yard keeping his distance from Lee. I detained Lee at this time so I could speak with [VICTIM #1]. While handcuffing Lee he began tensing up and taking a minute to comply with my commands. Lee was placed in the rear seat of my patrol car.

I spoke with [VICTIM #1] after he was evaluated by Madison County EMS and denied transport. [VICTIM #1] advised following an argument between them and Lee he was slapped by Lee the pushed to the ground where he was struck in the left arm with some kind of blunt object. Later believed to be the black metal pipe which had screws hanging out of the ends. This spot on his left arm was bleeding requiring to be bandage. There were also lacerations behind both of [VICTIM #1] ears that were bleeding, unknown if he sustained these during the fall and while Lee was hitting him.

[VICTIM #1] stated while he was down on the porch [WITNESS #1] tried to stop Lee. [VICTIM #1] stated Lee had moved out but was back for a few days due to relationship problems. [VICTIM #1] was advised that Lee would be going to jail for the family violence charges.

A large sum of US currency was located on Lee’s person and he requested it go with him to jail. The money consisted of $4300.00 dollars in 50 dollar bills and $440.00 dollars in 20 dollar bills, totaling $4740.00 in cash. All this was placed into Lee property at his request. I transported Lee to the Madison County Detention center where he was turned over to on duty jail staff.

I will be obtaining warrants for aggravated assault FVA, battery FVA, and cruelty to children in the 3rd. I obtained the metal pipe placing it into evidence. Victim notifications were completed. The TPO process was explained to all parties.
