On 04/20/2026 at approximately 02:32 hours, I, Officer M. Goetsch (P-11), responded to [100 BLOCK] Tennyson St. NE in reference to individuals trespassing on the property, reportedly located in a camper at the rear of the residence.
While in the area of Carroll Street, which runs along the rear of the property, I observed three individuals walking westbound. I made contact with the individuals, who consisted of two males and one female. The female was holding an infant child.
During the encounter, one of the male subjects was identified as a grandson of the property owner; however, he had previously been advised he was not permitted to be on the property. The female stated she believed she had permission to be on the property, advising that this information had been provided to her by the third male subject. Upon being advised to leave, the female complied without incident and departed the area.
The third male subject was identified as Mr. Aaron Johnson (DOB: [REDACTED]). Mr. Johnson provided inconsistent statements regarding where he had come from and his reason for being on the property. He was unable to provide confirmation that he had permission to be on the property. During the encounter, Mr. Johnson admitted that when the property owner observed them inside the residence, they were told they were not allowed to be there and were instructed to leave.
Despite being previously advised by the property owner and again being instructed by law enforcement to leave the property, Mr. Johnson refused to comply. The property owner subsequently contacted 911 to report the trespassing.
Additionally, due to the time of night (approximately 02:30 hours), Mr. Johnson’s presence on private property without authorization, and his admission that he had been previously told to leave the property, his actions were such as to warrant a justifiable and reasonable alarm for the safety of the property and its occupants.
Mr. Johnson admitted to being inside a structure (camper/residence) on the property after being told he was not permitted to be there. His presence in an area not open to the public, combined with prior notice to vacate and inconsistent statements regarding his purpose, further contributed to the alarm. Mr. Johnson was afforded the opportunity to dispel this alarm by explaining his presence; however, he failed to provide a credible or lawful explanation.
Based on my investigation, including Mr. Johnson’s admission, prior notice given by the property owner, his refusal to depart after being directed to do so, and his failure to dispel alarm regarding his presence, probable cause was established. Mr. Johnson was placed under arrest for Criminal Trespass (OCGA 16-7-21), Loitering or Prowling (OCGA 16-11-36), and Disorderly Conduct (OCGA 16-11-39).
During transport, Mr. Johnson became disorderly by yelling loudly, kicking the interior cage of the patrol vehicle, and creating a disturbance, requiring repeated verbal commands to gain compliance. Due to his actions, he was additionally charged with Disorderly Conduct (OCGA 16-11-39).
Mr. Johnson was handcuffed, double-locked, and checked for proper fit prior to being secured in the rear of my patrol vehicle. He was transported to the Pelham Police Department for processing. Upon completion of paperwork, Mr. Johnson was turned over to a Mitchell County Sheriff’s Office deputy for transport to the Mitchell County Jail, where he was released into jail staff custody without further incident.
