On this day at 01:46 PM Sgt. McCarver, Ofc. Southern, and I responded to a call for service at [1600 BLOCK] Duvall Rd Apartment [REDACTED], Chatsworth GA, 30705. The call was about three males and 1 female at the apartment and two of the males were fighting in the parking lot of the complex. While I was enroute dispatch advised us two of the males left walking toward Duvall Rd.
I got there at 01:52 PM and found a female sitting in a car outside of the apartment. I spoke to her and asked if there were people fighting. She said yes and that the fight was between her husband and brother. I asked where they were, and she said her husband [VICTIM #1] was walking to the store while her brother (Kenneth Dagnan) was just inside. I asked her what [VICTIM #1] was wearing, but she said she did not remember nor what store he was going to. I relayed the information to Sgt. McCarver who was still on his way and asked him to check Smile Fuels.
While I was speaking to the female another male approached me, and she said it was her other brother. This male who was later identified as [JUVENILE #1]. He did not have on a shirt or shoes, and he was unsteady on his feet as he approached. He said he was walking with [VICTIM #1], so I asked where he went and what he was wearing. He said [VICTIM #1] went to the store and did not remember what he was wearing.
I went to the apartment, knocked on the door, and asked Kenneth to come out. He did, and I noticed he was swaying in the doorway and using the door to prop himself up. His eyes were also watery. I asked him what happened, and as he spoke I detected an odor of an alcoholic beverage emanating from his breath. He started by admitting to me he had drank alcohol while underage. He said he was nineteen.
He explained the argument was over [VICTIM #1] thinking Kenneth drank his alcohol when he did not. He was frustrated that [VICTIM #1] did not trust him and the reason they were arguing. I asked him who’s alcohol he drank, and he pointed to his sister saying “theirs.” Kenneth said they only argued verbally, and [VICTIM #1] left because he was mad.
It was around this time I saw Ofc. Southern arrive on scene and speak to [JUVENILE #1]. Also, I heard on the radio Sgt. McCarver located [VICTIM #1] near Victory Fuels. I began getting Kenneth’s information when dispatch advised Ofc. Southern to be enroute to Sgt. McCarver’s location due to not answering the status checks. Therefore Ofc. Southern left the scene, and I began speaking to [JUVENILE #1].
[JUVENILE #1] started off by also admitting to drinking three “shots”. He said he was in [VICTIM #1]’s room looking for a “dispo” I asked him what that meant and he said it was a THC vape. He explained he was on his hands and knees looking for the THC vape when he found the alcohol, so he drank three shots. [VICTIM #1] found out about this when Snapchat pictures were sent to him, so [VICTIM #1] came back home and called their parents to pick them up. He said an argument ensued between [VICTIM #1] and Kenneth with Kenneth getting in [VICTIM #1]’s face, but it did not get physical.
Sgt. McCarver then called me. He said he spoke to [VICTIM #1], and he said Snapchat photos of them drinking alcohol were sent to him, so he came back home. When he got home an argument ensued with Kenneth getting in his face spitting on him as he spoke. Therefore, [VICTIM #1] pushed Kenneth away and he left walking.
I concluded the phone call and approached Kenneth. I placed him in handcuffs behind the back, ensuring proper fit, and double locking the cuffs. I escorted him to the front of my patrol car, and about that time [JUVENILE #1] started screaming and crying. He beat his closed fist on the car he was propped against as well as rapidly sitting down and standing back up again. His parents who were on scene at this time tried to calm him, but he continued.
Ofc. Southern arrived on scene, so I asked him to watch Kenneth. I went to [JUVENILE #1] and placed him in handcuffs behind the back, ensuring proper fit, and double locking the cuffs. Sgt. McCarver arrived on scene at that time, and [JUVENILE #1] was placed in Sgt. McCarver’s patrol car. As soon as Sgt. McCarver closed the door [JUVENILE #1] started hitting his head up against the window. Sgt. McCarver opened the door, told him to stop, and closed the door again. [JUVENILE #1] did not continue hitting his head. Both [JUVENILE #1] and Kenneth were transported to the Murray County Detention Center without incident. Kenneth was cited for disorderly conduct while [JUVENILE #1] was cited for public drunkenness.
