On 02/08/2026 at about 22:38, I, Deputy R. Hammontree, and Deputy Burch were dispatched to [200 BLOCK] Twin Lakes Rd in reference to a disturbance involving Timothy Joseph Lewallen.
I met up with [VICTIM #1], who stated that Timothy Joseph Lewallen had been drinking and throwing objects in the household for the majority of the night and had become upset with him and attempted to bite him on his left ear, threatened to fight him while making a fist, and acted like he was going to strike him. Timothy Joseph left the scene before the deputies’ arrival.
After checking the area and had negative contact, we spoke with [VICTIM #1] and asked him if he keeps his building locked, and he advised that he does not. I asked him if he had a key, and he stated that he did not and was advised that we could force entry into the building. After forcing entry, we had negative contact.
Shortly after we left the residence, Timothy Joseph arrived back on scene and fled into the neighbor’s yard after [VICTIM #1] called Murray 911 to advise that he was there. After arriving on scene, we located him in the woods while at Taser Point, giving him verbal commands to step out of the woods and into our custody. After he stepped out of the woods, he threw himself onto the ground, and on his back, I had to assist him to roll onto his stomach and place him in handcuffs while checking for proper fitting and double-locking them.
After we helped him onto his feet and walked him to my patrol vehicle, he attempted to take off running while I had him by his right arm and was stopped by pulling him back to me and to regaining control of him, while Deputy Burch controlled the other arm to prevent him from running again, and escorted him to my patrol vehicle without further incident.
Before arriving at the jail, Timothy Joseph stated he pleads the 5th and will not speak with us. After arriving at the jail, I informed him that even though he stated he pleaded the 5th, I was still going to read him his Miranda rights just in case he changed his mind. While reading Miranda to him, he would not stand in one spot or pay attention to what I was reading, and after completion, he still did not want to speak with me about what had happened at his residence.
While Timothy Joseph was being booked in, he turned around and took his hands off the counter and did not want to comply with the questions he was being asked or with the jail officer’s commands to turn back around and place his hands on the counter. Deputy Burch then gave him a verbal command to turn around and place his hands on the counter, and that was when Timothy Joseph took an aggressive stance that indicated he was going to fight us, puffing his chest up, clenching his hands, and speaking loudly towards Deputy Burch. This was when Deputy Burch placed his hands on Timothy in an attempt to turn him back to face the counter.
Shortly after Deputy Burch attempted to gain control of Timothy, he actively resisted while making a fist with his right hand and looked as if he was going to strike Deputy Burch. I then approached Timothy from his right side to gain control of his right arm and assisted him to the ground to prevent him from striking Deputy Burch. Timothy was placed into the restraint chair and turned over to jail staff without further incident.
Timothy was charged with O.C.G.A 15-5-20(D) Simple Assault-Family Violence, 16-11-39 Disorderly Conduct, and O.C.G.A 16-10-24(E) Obstruction of law enforcement officer (M) on warrants.
