Officer’s Narrative:

On August 5, 2022 at approximately 0330 hours, I was patrolling on Veterans Parkway in Columbus, Georgia. I observed a set of headlights approaching my vehicle from the rear at a faster speed than the posted speed limit of 45 miles per hour. I slowed down and allowed the vehicle to approach my patrol car. The vehicle topped a Hillcrest and I verified the speed of the vehicle to be 59 miles per hour using the Radar system mounted in my patrol vehicle. As the vehicle passed me on the left, I conducted a traffic stop.

The vehicle pulled into a nearby private parking lot and stopped. I made a driver side approach to speak with the driver. The driver immediately began making statements that he did not do anything wrong and that I had no reason to stop him. I asked the driver to step from the vehicle and he initially refused. I then opened the driver side door and told him to step out. After a brief conversation, the driver stepped from the vehicle.

I explained to the driver the reason for the stop. As we spoke, I detected the strong odor of an alcoholic beverage emitting from his breath. I asked the driver about his beverage consumption and he admitted to drinking a few Coronas. He stated he last drink was a few hours prior to driving. I asked the driver if he would allow me to make sure he was safe to drive and he agreed.

I medically cleared to driver for the Horizontal Gaze Nystagmus evaluation. During the evaluation, he exhibited 6 of 6 clues without vertical Nystagmus. The Walk and Turn and One Leg Stand evaluations were not performed due to the uneven surface of the roadway and pavement.

I asked the driver if he would provide a sample of his breath and he agreed. The driver provided a sample in to the Alcosensor which displayed a positive presence for alcohol and an estimated breath alcohol concentration of .101.

I then explained to the driver that he was being arrested for driving under the influence. I then read the driver the Implied Consent Notice Suspects 21 or Over and requested that he submit to a sample of his blood. The driver stated that he had already taken the blow test. I reiterated to the driver that it was a blood test and he verbally refused.

The driver contacted a friend who retried his vehicle without incident. The driver was then transported to the Muscogee County Jail where he was issued the appropriate citations and released into jail custody.
