On September 4, 2022, at approximately 0253 hours, I was called by the Troop D Comm Center to assist Columbus Police with a possible impaired driver at the Whisperwood Apartments on Flat Rock Road.

Upon my arrival, I met with Cpl. Rosado. He stopped a Toyota Camry that entered the apartments from Flat Rock Road. The Camry had a flat tire. The driver drove past the call box, reversed and struck a curb, then entered through the gate. The driver identified himself with a Georgia driver’s license as Davaris Marquis Belle. I asked Mr. Belle to step out of the car. I could smell the odor of an alcoholic beverage coming from his breath as he talked. The rear passenger spare tire was flat and appeared to have been driven from an extended distance on the rim.

He said that he had had a drink in Stewart County. I administered the Horizontal Gaze Nystagmus Test. I observed the lack of smooth pursuit, distinct and sustained nystagmus at maximum deviation, and the onset of nystagmus prior to 45 degrees. The next test was the Walk and Turn. He broke his stance during the instructions, missed heel to toe and stopped waling after nine steps. The last test was the One Leg Stand. He swayed, raised his arms, and put his foot down. I requested a breath sample on the Alco-Sensor FST. His sample was positive for alcohol (.098).

I placed Mr. Belle under arrest for Driving Under the Influence of Alcohol. I read him Georgia’s Implied Consent Notice for suspects age 21 or over and requested blood. He said yes. I transported him to the Saint Francis Hospital lab where Mr. [REDACTED] administered the blood draw. I transported and released him into the custody of the jail.
