On September 3, 2022 at approximately 2345 hours, I responded to assist with a traffic crash that had occurred in the intersection of Veterans Parkway and River Road. I conducted a crash investigation on scene. For the results of that investigation, see traffic crash report 0000850637 for further information.
Due to possible injures, the driver was transported to Columbus Piedmont by Columbus Police Department. I arrived at the hospital and located the driver in the holding area. The driver was seated on a bench and had been secured in handcuffs. His hands were handcuffed in front of him.
I informed the driver of who I was and the purpose of me speaking with him. Since he was detained and before obtaining any information, I read the driver his Miranda Warning. I asked the driver if he would speak to me without a lawyer present and he verbally agreed to do so.
I gathered the driver’s information and allowed him to explain the crash to me. As he spoke, I noted the strong odor of an alcoholic beverage emitting from his breath. His eyes were watery and reddened. I asked about his alcoholic beverage consumption and he stated that he had been at a friends house earlier. He had been drinking with them all afternoon. He stated that he had drank a few beer and mixed drinks.
I explained to the driver the Horizontal Gaze Nystagmus evaluation. He did not have any stated medical issues that would prevent his participation. During the evaluation, the driver exhibited 6 of 6 clues. Due to the confined space and his detainment, the Walk and Turn and One Leg Stand evaluations were not performed.
At 0225 hours, I explained to the driver that he was under arrest for DUI. I read the driver the appropriate Implied Consent Notice and requested he submit to a state administered test of his blood. The driver verbally agreed and a phlebotomist was requested. At 0315 hours, [REDACTED] withdrew two vials of blood from the driver. The blood kit was subsequently sealed and sent to the GBI Crime Lab for analysis.
After receiving medical clearance, the driver was transported to the Muscogee County Jail. He was issued the appropriate citations and released to jail authorities without incident.
