On the listed date and time Deputy Franklin was dispatched to [100 BLOCK] Robin Road in reference to a assault that had already occurred.
OFFICER OBSERVATIONS:
Once arriving on scene Deputy Franklin noticed a male standing in the road bleeding heavily from the head. Deputy Franklin noticed the male staggering back an forth. The male was speaking Spanish. Once inside the ambulance Deputy Franklin noticed one large laceration on victims forehead, one laceration behind his left ear, and one laceration to the back of his head. Deputy Franklin also noticed heavy swelling to his forehead and the back of his head around the lacerations.
DEPUTY ACTIONS:
Once seeing the male’s injuries Deputy Franklin advised Dispatch to have EMS enroute for medical treatment. Deputy Franklin also had dispatch contact on-call Investigator. Investigator Alberto 9166 contacted Deputy Franklin at approximately 5:26 am. Deputy Franklin explained to Investigator Alberto his observations of the male and the interior of the residence after making entry.
OFFICER OBSERVATIONS OF RESIDENCE:
Deputy Franklin, Johnson, and Corporal Walls entered into [100 BLOCK] Robin Road through a open front door. Deputies could see from the outside of the residence blood, and several alcohol bottles throughout the living room of the residence, and some of the bottles were broken. Deputies also noticed that the furniture was out of place and some pictures off the wall on the floor.
Deputies noticed a big pool of blood in the living room near a red hat, which appeared to be where the assault transpired. Deputy Franklin noticed that the bleeding male walked from the living room to the bathroom area due to blood leaving the living area going into the bathroom into the sink area. Deputy Franklin also noticed blood on the interior and exterior of the residences screen door.
VICTIM STATEMENT:
Once the male entered the back of the Ambulance, the EMS personal was able to speak to him in Spanish. The male began to state that his name was [VICTIM #1], and the residence of [100 BLOCK] Robin Road belong to his cousin Mario Hugo Gutierrez Hernandez. Mr. [VICTIM #1] continued to stated that they were inside of the residence drinking and smoking marijuana. Mr. [VICTIM #1] stated that out of nowhere Mr. Hernanadez hit him in his head with a Tequila bottle, and then got in his vehicle and drove away.
IN CONCLUSION:
Deputy Franklin photographed the interior of residence along with Mr. [VICTIM #1] injuries. Deputy Franklin notified Crime Scene and spoke with Corporal Sellers 9119, who stated he was enroute to process the scene. Mr. [VICTIM #1] was transported to Piedmont Newton where Investigator Alberto met with him.
