On May 16, 2026 at about 2026 hours, I responded to Interstate 20 west bound near mile marker 100. The caller stated there was a truck that was all over the roadway. The caller stated there was a lawn mower in the bed of the truck. The caller stated the truck went into the center median and struck the median barrier cable. The truck then stopped and left the scene without calling 911. There was damage to the cable barrier. The caller lost contact with the truck just went of the 98-mile marker.
Deputy J. Restivo #9215 stated he saw the truck hit Flock on Highway 142 north near Interstate 20. I located the truck parked in the parking lot of Home Depot at 2037 hours. The tag number was the same tag number as what the caller gave. I parked behind the truck and walked up to the driver’s side window of the truck. The truck was running as I walked up. I saw the driver put the truck into drive and he started to pull off. I hit the side of the truck with my hand and yelled for the driver to stop; he stopped.
I had the driver open the driver’s side door. I asked the driver to step out and he did. I could smell an odor of an alcoholic beverage emitting from the truck. His eyes were glass and he looked confused. As he got out of the truck, he was unsteady. There was damage to the driver’s side of the truck and I asked him what happened to his truck and he stated it’s a land scaping truck.
I asked him did he have a crash and he stated he did not think so. While he spoke, I could smell an odor of an alcoholic beverage emitting from his breath. I asked him how much he had drank and he stated nothing. I walked round the truck and I saw a glass bottle of Patron in the passenger’s front seat floor board. There was liquid in the bottle. I had him walk to the front of my patrol car. I had to tell him several times when I needed him to compete simple task such a stop turn around and face me. He was not wearing any glasses or contacts. I also completed a medial rule out.
Horizontal Gaze Nystagmus Instructions (HGN)
Clues: I could not get Mr. Booker to keep his head still long enough to get a reading from the evolution. After several attempts I decided to move along to the next evolution. I told Mr. Booker I would like to move along and he stated he was tired. I told him there was an open bottle of alcohol in the floor board and I asked the officer to go get it and when he opened the door it fell out and broke on the ground.
I demonstrated and explained the evolution to him. I asked Mr. Booker if he understood and he stated we were about to find out. Mr. Booker used a white line in the parking lot.

Improper turn: I told him to turn around since he did not complete the evolution correctly. He also stated on the wrong foot. He used his truck to balance as he walked past it. Wrong number of steps: yes, 45 on the first and I stopped him for the second part. He did not count out loud.
One leg stand (OLS); (Four clues). I demonstrated and explained the evaluation to him. I asked him if he understood, and he stated I got you; I told him he could begin when he was ready. He picked his right foot up and then crossed over this left foot where he lost his balance. I asked him if he wanted me to show him how to again and he stated he did so I did. He attempted several times but he was unable to. He almost fell over and he said you know I can do this. I asked him why and he stated but he could never give me an answer as to why he could not complete the test. After 30 seconds, the evolution was over.

I asked Mr. Booker if he would take a portable breath test and he stated he would. I asked him had he ever taken one before and he sated he had. The reading was positive with a reading at 0.247.
I arrested Mr. Booker at 2101 hours. I placed handcuff son his behind his back. I checked for fit and double locked them. I searched him as well. I placed him in the rear of my patrol car. I rear Georgia Implied Consent Notice for persons over 21 years of age. I asked for breath and he stated he did not understand. I told him I needed for him to stop talking so I could read it to him again. I asked for breath and he stated he did not know what to say. He just wanted to go home. I told him I just need a yes or a no question answered. I read ICR to him again. I asked for breath and he stated I’m not going to say no, he told me to run my test at 2108 hours.
I called for next list and Belcher’s Towing removed the vehicle. I transported Mr. Booker to the Newton County Sheriff’s Office where I ran the Intox 9000 (serial number 90-007481.) Operator number 958401. The first reading was at 2129 hours with a result of 0.248. The second reading was at 2134 hours with a result of 0.241. I cited Mr. Booker and released him to the jail staff. There were no reported injuries. I secured my firearm and ammo in my patrol car at the jail. A supervisor was advised of the arrest.
He asked me about 15 times what county he was in. While he was signing his citation, he stopped signing them about half way through so I had to out refused to sign on the ones he would not sign.
