On Friday September 25, 2026 at 2358 Hours, the Newton County Sheriff’s Office responded to a suspicious call on Silver Ridge Road at Blanket Pass in reference to a vehicle parked at the mailboxes with one individual laying on the ground and another standing over them. When Deputy Sydnor arrived at 0002 Hours, the vehicle was backing out of parking and was in motion.
Deputy Sydnor made contact with the driver, later identified as Xavier Allen. Deputy Sydnor suspected that Allen was possibly under the influence of alcohol and requested for a H.E.A.T. unit to be en route to conduct SFST since he was not trained in fields. I responded to the scene and arrived shortly after his request at 0009 Hours.
When I made contact with the driver, identified by his Georgia Driver¿s License as Xavier Allen, he admitted to drinking alcoholic beverages while in his vehicle and stated his plan was to get in the backseat and fall asleep. When asked how much he had consumed, Allen stated they had a few shots “along the way.” He then volunteered to go through field sobriety because he felt that he was safe to drive. I smelled the odor of alcoholic beverage on Allen’s breath and clothing. His eyes were also glassy and watery.
Allen confirmed he was not prescribed nor wearing contacts or eyeglasses. Allen also said he did not have recent head injuries. I began Standardized Field Sobriety by checking for Horizontal Gaze Nystagmus. Allen’s eyes were able to track a stimulus equally and his pupils were equal sizes. I observed the Lack of Smooth Pursuit and Distinct and Sustained Nystagmus at Maximum Deviation in both of Allen’s eyes. During the evaluation, Allen struggled to hold his head still. After telling him several times to hold his head still, I told him to utilize his hands to keep his head held in place.
The next evaluation I asked Allen to conduct was the Walk and Turn. Due to an injury to his right foot, Allen declined to participate in this evaluation.
The final evaluation conducted was the One Leg Stand. After explaining and demonstrating the evaluation, I asked Allen if he understood the instructions, and he said that he did. When told to begin, Allen chose to plant his left foot and raise his right foot. Allen began to sway on count “1,006” and raised his arms for balance. Allen reached a count of “1,018” in 30 seconds.
Following the conclusion of SFST, Allen submitted to a roadside Preliminary Breath Test. The PBT recorded a positive result for the presence of alcohol (0.149% BrAC). Allen was placed into handcuffs and informed he was under arrest for DUI Alcohol. Allen stated he was 34 years old. He was read the Georgia Implied Consent Notice for Suspects Age 21 or Older, and asked to provide a breath sample, which he consented to provide.
Following his arrest, Allen’s vehicle and person were searched. Allen’s vehicle was searched for open containers and also based on the odor of marijuana. Two open containers were located, a bottle of Jose Quervo and a can of Strawberry Margarita.
Allen was transported to the Newton County Jail. Upon arrival, he submitted to the state requested chemical test of his breath on the Intoxilyzer 9000 (Serial Number 90-007481). The test recorded a result of 0.139 Measured BrAC (g/210L). Allen was booked into the jail on a single charge of 40-6-391(a)(5) DUI Per Se. He was issued a Uniform Traffic Citation as well as a DDS-1205 Suspension Form.
