On 3/9/2026, at approximately 1515, I, Dep. Glenn responded to Oconee Veterans Park at 3500 Hog Mountain Rd regarding an incident of indecent exposure. I met with the complainant, who told me that while walking on the trail by the softball fields, she observed a man walking towards her. As the man approached, the complainant saw that the man had his p*nis out of the bottom of his shorts, mast*rbating.
The complainant told me that the man smirked at her while making this lewd exchange, then chuckled. The complainant immediately called 9-1-1, and the man ran away as she did. The complainant provided a description for the man, as well as a vehicle description for the car he left the park driving.
The description given was that the man was a young, light-skinned black male who was no taller than 5’6. The man wore a white shirt, black shorts, and possibly black shoes. The man had a short, Afro-style haircut that was only about 2 inches long, and wore transitional glasses that got darker in the sunlight. The complainant told me that the man drove a newer model white BMW sedan, and the license plate started with a ‘C’. I asked the complainant if she would recognize the man if she saw him again, and she said yes.
Dep. Rainwater did a Flock Safety search while Dep. Morris and I were headed to the park, and provided the license plate [REDACTED] for a potential suspect vehicle. The vehicle was captured on Flock Safety leaving Oconee Veterans Park at 1516. I entered the vehicle into GCIC/NCIC, and saw that the registered owner was a woman who had a home address on Black Ike Rd. Dep. Young looked up the address, and found a male associated with the address who matched the physical description given by the complainant.
After getting the complainant’s statement, Dep. Morris and I went to the address on Black Ike Rd. When we pulled into the driveway, I saw the white BMW parked, unattended. I knocked on the door of the residence, and it was answered by a young, light-skinned black male wearing a white shirt, black shorts, and glasses. This male later identified himself as Nicholas Swann. I asked Mr. Swann was the only one home, and he told me that he was not. He told me that his mom and girlfriend were inside the residence. I asked how old he was, and he told me 18-years-old.
I asked if he was recently at Oconee Veterans Park, and he said no. Mr. Swann told me that he had just picked up his girlfriend from Oconee County High School. I asked what vehicle he had been driving, and he told me the white BMW. I asked where he went after picking up his girlfriend, and he told me that he drove straight to the residence on Black Ike Rd. At this time, a woman identified as the registered owner of the BMW and Mr. Swann’s mother, came outside. Mr. Swann told his mother that he didn’t know what was going on. I asked her who drives the BMW. Mr. Swann spoke up, telling me that he was the only person who drives the vehicle.
The mother wanted to know what was going on, so I explained the park incident to her. After explaining the incident, Mr. Swann said, “That was not me. I promise.” I told him that he matched the description given by the complainant. He reiterated his statement about not being at the park. I told him that his vehicle was captured on the park cameras, then asked if he could explain that.
Mr. Swann said, “I mean, I went there for like minutes. I didn’t mean to lie to you.” He told me that he was only in the park from 1450-1500 hours. The Flock Safety search showed the BMW leaving the outside of that time frame. I asked Mr. Swann what he was doing in the park, and he told me that he wasn’t doing anything. I asked where he went inside the park, and he told me that he was parked near the softball fields, in the back, right parking lot. Mr. Swann told me that he never got out of his vehicle.
He began stumbling over his words when I asked him again if he was sticking by the statements he made. Dep. Morris began speaking with Mr. Swann. Dep. Morris specifically asked about why Mr. Swann’s clothing and glasses matched the description given by the complainant. Mr. Swann could not provide an answer. Dep. Morris asked if Mr. Swann was wearing transitional glasses. When Mr. Swann realized he was wearing transitional glasses, he told Dep. Morris that he didn’t know there was a special name for them.
Based on the totality of the circumstances, and Mr. Swann’s deception, I developed probable cause to arrest him for Public Indecency. He was handcuffed and searched incident to arrest by Dep. Morris. After he was secured into Dep. Morris’ vehicle, I asked his mom if I had her permission to take pictures of the inside of her BMW. I took pictures, and looked for black shoes. None were located. Mr. Swann was taken to the jail, and turned over without incident. On the way to jail, I called the complainant and asked if she could come to the Sheriff’s Office to do a photo lineup. She agreed to be there around 1700 hours.
I made a photo lineup with 6 people’s booking photos from Jail Tracker, our jail booking system. I asked Sgt. Ellis if he would administer it. During the photo lineup, the complainant picked out Nicholas Swann as the man she’d seen mast*rbating in front of her on the trail. Sgt. Ellis captured this on his body worn camera. The photo lineup was logged into evidence, and Sgt. Ellis asked her to make a written statement. These items were added to the report.
After the photo lineup, I went to the jail in an attempt to interview Mr. Swann under the Miranda warning. I read him the Miranda warning, and he agreed to speak to me. This first interview was not captured on body camera because mistakenly, it was not activated. During the first interview, Mr. Swann admitted to mast*rbating in front of a woman on the trail.
I made a second attempt at an interview, read Mr. Swann the Miranda warning, and he agreed to speak to me again. My body camera was activated the second time. Mr. Swann told me that he grew up watching kink pornography that included people flashing their genitals at others. He told me that this specific kind of kink stood out to him. He told me that on this date, he left his house around 1430 and got to Oconee Veterans Park around 1455.
At the start of the second interview, Mr. Swann initially told me that he didn’t remember telling me that he mast*rbated in front of someone. He told me, “I was scratching my groin in action to show my genitals to this woman as I was passing her.” When I told him this statement was inconsistent with the statement he previously gave, he told me that he’d stick with his previous statement. Mr. Swann said, “I wasn’t ferociously jacking off!” Afterwards, he told me that he was a liar when it came to survival instincts. He asked if I had already watched the park video before coming to his residence. When I told him yes, he started crying.
Mr. Swann said, “To be fully honest…on my way back from my walk, I was walking to my vehicle. I did take my d*ck out.” He continued, “And at first, I was kinda walking at this corner…as she approached, I started to jack off.” Mr. Swann told me that he really wasn’t looking at the woman on the trail. Instead, he said that he was looking off to the side. He said that he locked eyes with the woman, and saw her make a face at him. I asked what kind of face the woman made. Mr. Swann said, “A disgusted face,” before crying again with no tears coming from his eyes. He told me that he began running away as she called who he assumed to be 9-1-1.
During this interview, Mr. Swann told me that there had been more incidents involving the lewd display of his genitals at the park. He told me that there were at least 2 more incidents involving him getting out of his vehicle, and “flashing” people at the park. He said there were maybe 6 or 7 incidents that involved him mast*rbating inside his vehicle at the park.
I asked if there was something specific he looked for before deciding to show his genitals in the park, and Mr. Swann said, “It’s like if I see a big butt.” I asked if this is what had taken place on this date, and he said yes. I asked how he was able to see the woman’s butt if they were approaching each other from the front, and he explained the moments leading up to the encounter. Mr. Swann told me that on the portion of the trail they were on, there was a sharp corner. When the woman turned in the corner, following the trail, Mr. Swann saw her butt. After seeing the woman’s butt, he decided to walk to her.
I followed up on a previously reported incident with a different complainant at Oconee Veterans Park, and asked if she would be able to come to the Sheriff’s Office for a photo lineup. She agreed. While at the Sheriff’s Office, Dep. McCannon administered the photo lineup, and told me that this different complainant also picked Mr. Swann out as the person involved in her incident.
Mr. Swann was charged with 2 counts of Public Indecency. Warrants were sworn, and all relevant forms are attached to this report. Mr. Swann’s phone was confiscated, and logged into evidence. Reference case number 202602000255 for more info on the other complainant’s incident.
