On the above time and date, I, Deputy Dely, responded to Bone Cir/Colbert Dr, in reference to a welfare check.

Before arriving on scene, I spoke with the complainant, [WITNESS #1], over the phone. [WITNESS #1] advised that while outside his house, he heard a female screaming. He stated the screaming sounded like a female in trouble. He stated he attempted to drive towards where the sounds were coming from; however, when he arrived at the entrance of the neighborhood, the screaming stopped.

Once arrived on scene, I attempted to drive around the area to locate the unknown female who was screaming. I then observed a female near some trailer homes located at [300 BLOCK] Colbert Rd. I made contact with a female named [VICTIM #1]. I then advised [VICTIM #1] of the situation and asked if she was the one screaming. She stated she was the one screaming, and I asked her what had occurred. While speaking with her, I did observe blood on her clothes and on the side of her head.

[VICTIM #1] stated she had gotten into an argument with her ex-boyfriend, James Kuyendall. During the argument, James had grabbed a green flashlight and struck [VICTIM #1] on the side of her head, causing her to fall down. She then began screaming and telling James to leave. She stated James would not leave until she threatened to call 911. She then stated he left in a white Jeep.

I then asked [VICTIM #1] what the argument was about. She stated James had been at the incident location since yesterday and had asked him to leave multiple times. Today at approximately 18:39, she returned home from picking up Mexican food. She stated that James got upset about the food. The hit from the flashlight caused [VICTIM #1] to bleed excessively from the side of her head. [VICTIM #1] was checked by Metro Ambulance personnel on scene, and she stated she was going to be fine. I also advised [VICTIM #1] to seek out a Temporary Protective Order (TPO) against James.

[VICTIM #1] stated she and James had been in a relationship for a couple of months, and had recently broken up with him. She also stated they never lived together. [VICTIM #1] then provided the address James lived at, [90 BLOCK] Covered Wagon Dr. I attempted to make contact with James at the referenced location. However, he was not there.

Warrants were then sought against James for Aggravated Assault-Family Violence. James used a flashlight, which is an object, device, or instrument that, when used offensively against a person, is likely to or actually does result in serious bodily injury.

Attached to the I drive are photos of [VICTIM #1]’s injuries, the flashlight used, and her clothes covered in blood. [VICTIM #1] also provided a statement form.
