On 10-08-25 at 1140 I got an email from the front desk at the Sheriff’s Office. The email read [WITNESS #1] a nurse from Paulding Wellstar Hospital was calling about an older woman who was at the hospital and was afraid to go home. I responded to the scene and started an investigation, took out warrants and wrote a report.

I met with [VICTIM #1] (DOB [REDACTED BY AGENCY]-1945) in the emergency room At Paulding Wellstar Hospital. Nurse [WITNESS #1] took me to her room. I asked [VICTIM #1] what was going on. She said she remembered me from the day before when I came out to her house. Sgt Dyer and Deputy Walker were on a domestic dispute at her house on 10-07-25 case number (2025-10070085).

I went to the scene to check on them, I arrived just as they were leaving so I didn’t speak to anyone except Sgt Dyer and Deputy Walker. I asked her why she was afraid to go home. She said her live in boyfriend Nathan Fishburne (DOB [REDACTED BY AGENCY]-1973) was at the house and she didn’t want him to hurt her. I told her I would help her but I needed to get more information and asked her if she could come up to the Sheriff’s Office when she got out of the hospital. She agreed and Nurse [WITNESS #1] got her discharge papers ready to go.

[VICTIM #1] came to the Sheriff’s Office, she picked up a TPO packet at the front desk. We went back to the patrol office were she filled the packet out and we spoke. She wrote out her statement on the TPO paperwork. I have attached it to the report. This is a synopsis and not word for word of what she wrote. She said on 10-07-25 she had a doctors appointment at 0800 she said she was finished around 1000. She then went to a chiropractic appointment where Nate called several times to see if she was there, then if she had left.

She said she got home around 1045 and Nate was already drunk. She said she left quickly to go get Nate’s prescriptions that were ready at the pharmacy. She said while she was there Nate called in two more prescriptions and it was going to take thirty min to get them read. She said she decided to go get her thyroid med’s at Sam’s while they got the prescriptions ready. She said while she was there he called on her where abouts. She said when she finished at Sam’s she went back to Walmart to get the rest of Nate’s prescriptions.

She said she got back home around 1500 and Nate met her at her car. She said when she got out he grabbed her Yeti cup and threw it across the yard then yelled where did she leave her boyfriend. She said she went inside. She said he followed her cursing and putting his hands in her face. She said he also got in her face and chest bumped her as he was continually cursing her. She said he was very angry because she wouldn’t hold his hand. She said she was trying to clean the kitchen and wash the dishes when he began to bang the dish pan over the dishes. She said he then threw the dish pan off the back deck into the yard.

She said that’s when things were getting out of hand so she called 911. Sgt. Dyer and Deputy walker came out and spoke to both of them. She said they told them to stay away from each other and let things calm down. [VICTIM #1] said Nate didn’t listen and went to the store for more beer. She said he came home and drank the beer he bought then they ate dinner and Nate fell to sleep for 2.5 hours. She said when he woke up and notice she wasn’t beside him he came looking for her and found her in the bathroom. She said she was brushing her teeth and washing her face getting ready to get in the shower.

She said all the while he was cursing her and getting in her face saying hurry up get your shower. She said as she was in the shower Nate kept turning the water off and on then as she was soaped up he threw the snuff in his can all over her head and body. She said he then took his change and threw it in the shower. She said as she was drying her feet Nate came and slapped her pony tail from it’s position and started putting his hands in her face. She said she asked him to stop but he continued to harass her telling her he was going to call the Sheriff. He said “she was going to jail so you need to get your clothes on”.

She said she put her clothes on with the intension to leave. She said she got dressed and grabbed her thyroid medication to leave, she said Nate took her phone while she was in the shower so she asked for it back. She said he denied having it but as she went to leave he told her it was under her pillow. She then tried to get her charger from him and after some arguing he gave her the cord and she found the end on the kitchen table.

She said when she was ready to go she was walking from her bedroom when he kicked her in the rear end four times and slapped her thyroid medication out of her hand causing the top to come off spilling 3/4’s of the pills all over the floor. She said she needs that medication and can’t get more so soon. She said as she left Nate said he was calling the Sheriff and telling them she had been drinking so they would lock her up. She said she left and drove herself to the hospital because her blood pressure was 176/96. She said she spent the night in the hospital to be monitored.

She said Deputy Childers came to the hospital this morning (10-8-25) at 0529 and she told him the same story. She said he gave her some advice and told her because she didn’t have marks he was not taking any warrants. Deputy Childers wrote a supplemental to case #2025-10070144.

Deputy Childers told me that Deputy Parks-Lewis and Deputy Delay came out to the house last night after Nate called for the same call. Deputy Parks-Lewis and Deputy Delay wrote this report for case #2025-10070144.

“Upon arrival, I spoke with Nathan Fishburne. Nathan stated he had gotten into an argument with his girlfriend, [VICTIM #1], right before he called deputies to his residence. Nathan stated that the argument turned physical when [VICTIM #1] hit him in the face several times. Nathan stated [VICTIM #1] then left the scene in a red Dodge Journey, possibly heading onto Marshall Fuller Rd, going to her daughter’s house. I then asked Nathan what started the argument. Nathan stated the argument started over [VICTIM #1] being out all day and not returning home. The altercation happened in the living room, where [VICTIM #1] hit him in his face using her hands. Nathan also stated they were both intoxicated.

I was able to observe scraps and bruises on Nathan’s face. However, we were unable to make contact with [VICTIM #1] when Nathan attempted to call her to get her side of the story. Nathan also stated they both had been drinking. We photographed the injuries on Nathan’s face and he advised that he did not require medical attention. We told Nathan we would attempt to make contact with [VICTIM #1] at the location he said she would be at. Once we finished speaking, we went to the referenced location where [VICTIM #1] could possibly be located. However, we were unable to make contact with [VICTIM #1] or locate her vehicle.

Due to not being able to make contact with [VICTIM #1], we were unable to obtain her side of the story. Also, when speaking with Nathan, it was apparent that he was heavily intoxicated. When we first spoke with Nathan, he wouldn’t give the exact details of what exactly happened during the altercation or what led up to it. Also, once again, due to Nathan admitting to both parties being intoxicated, I was unsure if anything else happened to [VICTIM #1] during the altercation. I advised Nathan that a report of the incident would be made; however, I did not seek charges against [VICTIM #1] due to the above-referenced factors.

Attached to I drive are the photos of Nathan’s injuries.

I spoke to [VICTIM #1] about the what Nate said happened last night. She said it was very possible that she may have scratched him because he kept putting his hands in her face. I asked her if she was drunk last night she said no. I met her at her house to look for Nate. He wasn’t there so she asked us to clear the house. As we walked around the back of the house I took a picture of the dish pan out in the yard. While in her bedroom I notice very small lime green pills on the floor some that had been stepped on. [VICTIM #1] said that was some of her thyroid medication. I took pictures. Nate wasn’t there I gave [VICTIM #1] a card and asked her to call if he came back. She asked if I would come to the court house tomorrow to help her with the TPO I said I would.

[VICTIM #1] called later and said Nate took some of her stuff when he left. I told her to make a list and I would get it at court tomorrow. I went back to the Sheriff’s Office and took out two warrants for simple battery FVA victim over 65 years old. One for kicking her four times and the other for slapping the thyroid medication out of her hands spilling it.

The judge signed the warrants and I put them in the warrant box. The next moring Capt Kilgore called for information on Nate. I answered his questions and he sent a picture of Nates truck going down Ridge Rd on 10-08-25 at 0818 with a blue cooler in the back.

On 10-09-25 at 1200 I met [VICTIM #1] at the court house and she gave me the list of stolen items. I showed her a picture of Nates truck on Ridge Rd and asked if that was her cooler she said yes.

I took a warrant for theft for the stolen items. The judge signed the warrant and I took the
warrants to the warrant division.
