On 12/06/2025, I, Officer Carroll, was dispatched to 301 North Highway 49 (Waffle House) in reference to an assault.

Upon my arrival, I observed three males standing inside the restaurant. I noted that one male’s jacket was wet, consistent with either a spilled drink or a drink being thrown on him. Upon making contact with the individuals, I was informed that the offender, Mr. Cross, had thrown water on the victim, Mr. [VICTIM #1].

I spoke with Mr. [VICTIM #1] and asked him to explain what had occurred. He stated he was seated at the lower bar eating when Mr. Cross approached him. [VICTIM #1] stated that Cross called him by an incorrect name and extended his hand as if to shake. [VICTIM #1] reported that when he attempted to shake his hand, Cross grabbed his hand and violently pulled him toward his chest. [VICTIM #1] stated he told Cross he had the wrong person, identified himself as “[VICTIM #1],” and instructed Cross to leave him alone. He stated Cross then began to yell at him, insisting that was not his name, before walking away.

According to [VICTIM #1], Cross returned to his own table for a few minutes before standing up and walking back toward him. [VICTIM #1] stated that Cross then picked up a glass of water and threw it on him. [VICTIM #1] reported that the male accompanying Cross then grabbed Cross and pulled him away. [VICTIM #1] advised that he then contacted 911.

I attempted to speak with Cross. While asking him for his identification, I detected a strong odor of an alcoholic beverage coming from his person. When asked if he had been drinking, he stated, “A little.” When asked why he threw the drink on [VICTIM #1], Cross stated that he had tripped.

As I attempted to place Cross in handcuffs, he tensed his body and began to passively resist. When I moved behind him, he stepped forward, at which time Officer Burtrum took hold of him. Both officers guided Cross to the ground, where we gained compliance and placed him in handcuffs. He was then secured in the rear of Officer Burtrum’s patrol vehicle.

I then spoke with Mr. [WITNESS #1], the male accompanying Cross, who stated he is Cross’s cousin. He confirmed the same account of events as provided by [VICTIM #1].

Cross was transported to the Byron Police Department for booking and subsequently transported to Peach LEC for housing.
