It was the end of the block party and the public was finally disbanding for the evening when we received a call that there was a white male with a light blue shirt that was at the U-joint, yelling at a female and appeared, as the caller said, to be intoxicated. Went to that location, could not find the individual, and began searching south on Main Street
I received another report from a citizen as they passed by that a white male in a light blue shirt had just passed them, was apparently very drunk, and had wanted to fight them. The person was not in the area, so I continued west until Officer Palmer and I arrived at the Vandiver, where it appeared that the person had crossed 76 and had walked up the street and had walked in the front door of the Vandiver.
Went into the hotel lobby to look into the Vandiver restaurant and did not see the individual. However, as we went back to the street, you could look in from the street view and see that he had taken a seat at a table at the end of the bar. The barman came out and we told him that we were looking for that individual because he was very intoxicated and had been very aggressive towards people on his way to this location. The barman went back in and apparently discussed it with the gentleman who came out.
As soon as the suspect stepped out of the door, he was very unsteady on his feet, almost tripped, raised his fists, looked at myself and Officer Palmer, and said, which one of you is first? At which point he tripped down the stairs and we caught him at the bottom of the stairs. I told him that we had received complaints that he had been intoxicated and that he had threatened to become involved in fights.
As he stood there, his eyes were glassy, his speech was slurred, he was unsteady on his feet, as had already been demonstrated by tripping coming out of the door, he was loud and unnecessarily aggressive. But also he was unable to stand upright without swaying from side to side. There was a slight smell of alcoholic beverage about him, and in my estimation, he was intoxicated.
He started using profanity, at which point we told him to stop, that this was a family event that had just broken up and there were still families with children that were in the area, and that we did not need that type of language and behavior. He continued uttering expletives and stating that he was just trying to get to the hotel where he had a room, at which time Officer Palmer went in to inquire whether the gentleman had a room inside, and the hotel said that he did not.
As we continued to talk, he started to use expletives again and was told that’s enough, that there was children and other people in the area and we did not need that around family events such as this, and that he had one of two choices, that he could either go into the hotel and go to his room for the night, or that he could go with us to the jail and be charged with disorderly conduct. He started walking towards the front doors of the hotel, turned slightly towards me and started saying, “you p*ssy, you c*nt”, and other expletives.
At that point he was told he was under arrest, reached for his left arm and he tried to pull away. Officer Palmer had contact with his right arm. I grabbed his left, pulled him behind him, and handcuffed him after a brief struggle. I then began searching him, telling him that he was being charged with disorderly conduct.
At this point he started commenting that he’d have our jobs, he would be suing us, that we didn’t know what we were doing, that we would be paying for this, that we were a “bunch of p*ssies, we were a bunch of cowards”, and that he would ultimately come out on the side of the legal issue for false arrest. At which point we had finished the search and had called a transport unit.
I turned him towards the street, he was fumbling with the handcuffs. I could not see his hands and thought maybe that I had missed something in the search. As I reached down to open his hands to see what he had in them, he clamped down on my left hand and dug his fingernails into my hands, drawing blood from my middle finger. I asked him to let go. He did not. I wrapped my right arm around the bottom of his chin and stood him up on his tip toes, using his chin as leverage, at which point I told him to let go of my hand, at which point he did.
After hant he continued verbal assault again, calling us “cowards, mother f*ckers, and p*ssies”, and that he would be suing us for false arrest and any other number of things, that this was the last day on our job. We put him inside a patrol car as a holding mechanism until the transport unit could arrive.
We transferred him to a transport unit because he was already aggressive and aggravated with both Officer Palmer and I, and any further contact with us would continue to escalate his behavior. Therefore, he was transported by another officer to the jail and booked on the charges of pedestrian under the influence and disorderly conduct.
