On October 3, 2026, police officers S. Chapman, J. Watts, and J. Nations from the City of Clayton responded to a report of a domestic dispute at [REDACTED], following a call from a neighbor. Upon arrival, they found a male and a female at the scene, later identified as [VICTIM #1] and Jose Diego Gomes Hernandez. The couple resides together and shares a child.
Neither individual spoke English fluently, so a relative on the phone provided interpretation for the officers. The officers attempted to separate the couple by moving the male away from the female. Jose Diego Gomes Hernandez was instructed by the officers to move away from [VICTIM #1], but he refused to comply, stating, “No,” and pulling away. He exhibited a strong odor of an alcoholic beverage on his breath. The officers decided to detain him, but he actively resisted. They were eventually able to handcuff him behind his back, ensuring that the handcuffs were double-locked and properly fitted before placing him in the rear seat of the patrol vehicle.
[VICTIM #1] reported that Jose had kicked her legs, resulting in bruises on her right calf and the upper inside portion of her left leg, both showing purple and blue discoloration. She also mentioned that he had hit her. Officer Chapman observed a round, swollen bruise on her left forehead near the hairline, as well as redness along the bridge of her nose extending to its tip.
[VICTIM #1] stated that Jose had briefly choked her during the incident, but reported that she did not experience difficulty breating, or diffciulty speaking during the incident. [VICTIM #1] reported that her neck was not injured. Officer Chapman observed no visible injuries to her neck. [VICTIM #1] was advised to seek medical evaluation for the reported choking, but she declined. No additional charges related to the reported choking were sought at that time.
Additionally, [VICTIM #1] revealed that while Jose was committing these acts against her, he was also holding their infant son, [REDACTED BY AGENCY]. [VICTIM #1] reported that the infant was not injured, and no obserable injuries were apparent during the investiagtion. However, the infant did witness the acts of family violence.
[VICTIM #1] declined medical attention from emergency services and refused information about FAITH services, stating her intention to leave soon to move to Florida to be closer to her family. Jose Diego Gomes Hernandez was arrested for battery FVA, cruelty to children in the third degree, and obstructing/hindering law enforcement. He was transported to the Rabun County Detention Center, where custody was transferred to the jail staff.
