On Sunday October 21, 2024, at 0100 at the address of 2400 Salem Road SE there was a call for service in reference to a vehicle accident that was turning into a fight. Once on scene there was a black male parked in a parking spot away from the initial spot of the accident. On scene I spoke with the male who identified himself as BRYCE ALEXANDER PEMBERTON of Covington Ga. When having contact with Pemberton, he was very aggressive, and in a fit of rage. Instructions that were given to Pemberton were not being followed while on scene. I left where Pemberton was and attended to the other person involved who identified himself as [VICTIM #1].

I spoke with [VICTIM #1] who advised that Pemberton was parked in front of his car in a parking spot, while his car was parked at pump 9 at the Quik trip gas station. [VICTIM #1] advised next that Pemberton proceeded to back up and hit the front end of [VICTIM #1]’s vehicle knocking out the grill in the front of the fender. [VICTIM #1] then advised that Pemberton tried to fight him after he had hit his vehicle, and when a friend of his came to the scene prior to me arriving Pemberton tried to fight him as well. I then gathered all the information for [VICTIM #1] to complete the accident report and directed my attention to Pemberton.

Once back with Pemberton his parents had arrived on scene, gathering information of what happened at the location. Pemberton was still hostile with all the deputies on scene and to get some type of order I asked everyone not involved with the accident to go back to their vehicle, which was his mom and dad. I then continuously asked Pemberton’s dad to go to his car which on the second request he complied with me. I then began asking Pemberton his whereabouts and had he ingested any alcoholic beverages recently, which he says he did not. I was inclined to believe that Pemberton did in ingested some type of alcoholic beverage, with that inclination, I asked Pemberton would he have a problem with doing a field sobriety test, to see if he is intoxicated. Pemberton agreed to do the test, and I began my initial testing which was HGN (Horizontal Gaze Nystagmus) While doing the HGN I noticed that Pemberton did not have a smooth pursuit of my finger, and he had refocused his eyes to catch up with my fingers during the test. By Pemberton not able to pursue my finger with his eyes, with my training, knowledge and experience, it shows that Pemberton was indeed intoxicated.

The next test I attempted to do was the walk and turn. As I was trying to explain the instructions Pemberton would not let me explain or give him the instructions to complete the task, Pemberton kept interrupting me and being very hostile. Being that I could not complete that portion of testing, it was my decision to determine that Pemberton was too intoxicated to drive a motor vehicle safely.

Pemberton gave some resistance while trying to place him in handcuffs along with other deputies. Eventually Pemberton was placed in custody, with handcuffs behind his back, and in my patrol car. Pemberton refused to get in the patrol vehicle and was assisted in the vehicle by other deputies. Pemberton had Implied consent to attempt to be read and he refused it by saying, “I aint blowing in sh*t” At that time he was taken to Rockdale County jail where he was booked and processed in by jail staff. Pemberton was charged with DUI (less safe), improper backing, simple assault and disorderly conduct. Warrants were taken out 10/22/2024.
