On November 2, 2025, at approximately 2328 hours, I, Deputy Torres, was dispatched to a suspicious person call at [80 BLOCK] Landola Dr NW, Sunrise Lakes, Conyers, GA 30012.

Prior to my arrival, we received two calls from neighbors reporting that a Black male wearing an orange hoodie and black pants was walking through the neighborhood, screaming, and carrying what appeared to be a gun while looking through people’s yards and vehicles.

Upon arrival, I made contact with Eric Penn. There was a concerned neighbor outside due to the commotion. I stopped my patrol vehicle approximately 30 yards from Eric, exited the vehicle, and drew my county-issued Glock 17, keeping it at a low-ready position and not pointed at him. I gave verbal commands for Eric to lift his shirt and spin around to check for weapons, and he complied. I then approached Eric and observed he was holding a pointed metal rod. I instructed Eric to drop the rod and walk towards my patrol vehicle.

During the interaction, Eric made statements about walking around to “kill the devil” and expressed beliefs that the devil was nearby. Eric’s behavior and appearance indicated possible recent narcotics use. While standing in front of my patrol vehicle, Eric became increasingly agitated, raising his voice and stating, “I’m not going in cuffs.”

I returned to my vehicle to run Eric’s information through GCIC. Once backup units arrived, I attempted to take Eric into custody. As I calmly instructed Eric to place his hands behind his back, he immediately tensed and began to pull away. I pushed Eric against my patrol vehicle’s front bumper to prevent further resistance. Eric grabbed the push bumper and continued to resist. He was warned several times to let go or he would be tased. After approximately three warnings, Eric was tased but still did not release his grip on the push bumper.

While Eric was under neuromuscular incapacitation, I used a force-under-power tactic to gain control by grabbing Eric’s chest and taking him to the ground. Eric was then placed into custody using two sets of handcuffs, which were double-locked and checked for proper fit. He was transported to the Rockdale County Jail, where he continued to act violently and belligerently towards deputies. The jail refused to accept Eric, so he was transported to Rockdale Piedmont for medical clearance. Eric refused treatment and was then transported back to the jail.

While taking Eric to the ground, I sustained injuries to my right elbow and pinky finger. I was unable to move my finger, and there was noticeable swelling.

Eric was served with a county ordinance.
