On September 8, 2025 by Deputy J Bradley responded to the address of [2500 BLOCK] Lennox Rd. SE. in reference to a domestic dispute.
Prior to my arrival, the caller later identified as [WITNESS #1] advise that she walked in on her father, punching and choking her mother on the floor. She advised that her father was intoxicated and was yelling and screaming in the bedroom. She also devised that he was possibly armed with a handgun and feared if deputies arrived with their blue lights on, he would possibly harm her mother with the handgun.
Upon my arrival, I could not hear any disturbance coming from the house such as yelling or screaming. I asked Dispatch if they could make contact with the collar to see if she could come to the door. They advise that she left the front door unlocked for us to enter Deputy Terrell, Deputy Stowers and I made entry into the home where again we could not hear any verbal disturbance or physical disturbance. However, we could hear a male speaking to someone upstairs we made our way upstairs. Are we located a bedroom and may contact with a blackmail later identified as Tyrese Smith and his young daughter we explained to him what was going on and asked to speak with his wife.
He stated that he did not have a wife. as we were speaking with Mr. Smith, the collar emerged from her bedroom and I spoke with her outside in the front yard. Miss [WITNESS #1] explain to me that she was in her bedroom and she heard a loud commotion and she heard her young siblings, crying and screaming from her father’s bedroom as she made entry into the bedroom she stated she saw her father on top of her mother, choking and punching her in the face while screaming at her, I asked her where where her mother at currently she was not sure where she was at at the time of us speaking.
I asked was her mother and Mr. Smith in a relationship she stated no however they share children together. I asked Ms [WITNESS #1] what her mother’s name was she stated [VICTIM #1]. After speaking with Miss [WITNESS #1], I slept back inside of the house to briefly speak with Mr. Smith and asked him was there any other adults in the house? He stated yes and advise that [VICTIM #1] was upstairs in the bedroom.
I went upstairs to speak with [VICTIM #1] and asked her what had occurred. She stated that her and Mr. Smith had got into a argument and advise nothing physical had occurred. I explained that her daughter [WITNESS #1] had called us and stated that she was being physically assaulted by Mr. Smith. Ms [VICTIM #1] deny those accusations stating that her and Mr. Smith got in each other’s faces, but never physically touched one another. I examined Ms [VICTIM #1]’s arms and face and could not see any visible marks or bruising. I asked would she like to write a statement she declined.
I went back downstairs to speak with Mr. Smith. I explained to him why we were called out and he stated that him and [VICTIM #1] had gotten into an argument, but also denied the accusations of him physically assaulting Ms [VICTIM #1]. He advised that [WITNESS #1] is not his biological daughter, but has known her since she was approximately one years old. He goes on to say that him and [VICTIM #1] had been having a long conversation since approximately 7 PM. Mr. Smith continues the state that nothing physical had occurred between him and Ms [VICTIM #1] I asked would he like to write a statement he declined.
At the time of this report, and during the course of my investigation, I found that I had insufficient probable caused to affect an arrest tonight for possibly simple battery – family violence. Ms [WITNESS #1] agreed to write a statement and also left the home to stay with family members, fearing for her safety inside of the home. Ms [VICTIM #1] stated at the argument, began over her allegedly disrespecting Mr. Smith in front of their young kids.
