On June 24, 2023 Deputy Young was on patrol when he witnessed a green jeep traveling West on Joel Poole Rd located in Seminole County, Ga fail to maintain its lane by driving on top of the center yellow line. Deputy Young initiated a traffic stop and identified the driver as Jenny Whitaker and explained the reason for the stop.
Whitaker explained to Deputy Young that she was riding on the center line due to problems with her vehicle. While talking with Whitaker Deputy Young witnessed her to have bloodshot watery eyes, smelled the odor of an alcoholic beverage coming from the vehicle, and witnessed an empty alcoholic beverage can (mikes harder lemonade) to be in the floor behind the drivers seat.
Deputy Young asked Whitaker how much she had to drink and she stated 1. Deputy Young asked about the beverage behind the seat and the passenger who identified as Marselle Andrews stated it was hers and when asked if there was anymore Andrews stated there was one in the center console.
Deputy Young asked Whitaker to exit the vehicle and asked her if she would consent to evaluations to ensure it was safe for her to drive and she stated she would. Deputy Young administered standardized field sobriety testing on Whitaker and made the determination that she was driving under the influence to the extent it was less safe for her to drive. The clues found can be seen in the DUI section of this report.
Deputy Young asked Whitaker if she would blow into a portable breath test and she stated that she was not comfortable doing that and she had already admitted to drinking. Deputy Young placed Whitaker under arrest without incident and immediately read her the Georgia implied consent notice for suspects age 21 or over and when asked if she would consent to the state administered chemical testing of her breath she refused by saying no.

Deputy Young then conducted a search of the passenger area of the vehicle and located the alcoholic beverage can in the center console and behind the drivers seat, and also located a black cup in the center cup holder which contained an alcoholic beverage.
Andrews stated all of the open containers belonged to her. Deputy Young issued Andrews a citation for open container. Deputy Young then awaited for someone to pick Andrews and Whitaker’s vehicle up at her request. Deputy Young then transported Whitaker to the Seminole County Jail where she was turned over to detention officers for booking procedures and issued her citations along with a DDS 1205 form.
