On Thursday May 7, 2026 I, Deputy McVey, responded in non-emergency mode to the area of Old Atlanta Rd and Rider Rd in reference to a two-vehicle crash.

Upon my arrival I made contact with a [VICTIM #1] (B/M dob -1999) who stated he was driving a Honda Civic (Tag# [REDACTED] VIN# [REDACTED] Cimarron Insurance Policy# [REDACTED]) when he struck another vehicle while traveling south bound on Old Atlanta Rd. [VICTIM #1] stated the other vehicle, a Hyundai Accent (Tag# [REDACTED] VIN# [REDACTED] Progressive Insurance Policy# [REDACTED]), was partially in the roadway while waiting for traffic coming southbound but was over the stop bar on Rider Rd. [VICTIM #1] stated he was not injured and that his vehicle was not drivable.

I made contact with the driver of the Hyundai Accent, a Byron Corbett (B/M dob-1967), who stated he was stopped at the stop sign on Rider Rd to turn onto Old Atlanta Rd. Byron stated he was hit by the other vehicle. While speaking with Byron I could smell the faint odor of an alcoholic beverage coming from his breath.

I returned to my patrol car, ran all vehicles and drivers on NCIC/GCIC. Byron returned showing to have a suspended driver’s license for DUI from August of 2025. Byron also had an active DUI permit going to school, employment, and medical appointments.

I returned to Byron, asked him to step out of his vehicle. While speaking with Byron, I could smell a strong odor of an alcoholic beverage coming from his breath. Byron stated he just dropped off his daughter at school, in Luella, and was going to get a haircut. I asked Byron when he last had a drink of alcohol, he stated he drank last night. Byron was asked how much he drank and he just mumble and did not answer the questions. I asked Byron if he would participate in the Standardized Field Sobriety Testing, and he agreed to.

I ensured the scene was free of any flashing lights so as not to interfere with his eyesight. Byron stated that he could see my index finger that was presented as I gave him the instructions for the Horizontal Gaze Nystagmus test. I positioned him facing away from traffic to begin the test. I began by observing that the pupils of both eyes were of the same size and checking both eyes twice for Equal Tracking. Once I confirmed Equal Tracking, I made two passes, checking each eye twice, and did not observe a lack of smooth pursuit in both eyes due to Byron anticipating where my finger was moving to.

After making two more passes and checking each eye twice, I did not observe a distinct and sustained Nystagmus at maximum deviation due to Byron not watching my index finger while at maximum deviation. I made two final passes, checking each eye twice, and did not observe the onset of Nystagmus prior to 45 degrees due to Byron anticipating where my index finger was moving to causing his eye to make small movements. I assessed a total of zero out of six clues for the Horizontal Gaze Nystagmus test, I made two passes, checking each eye twice, and did not observe a lack of smooth pursuit in both eyes due to Byron anticipating where my finger was moving to.

I instructed Byron to stand in a specific stance and to maintain that position until I instructed him to start the Walk and Turn test. I gave Byron instructions on how to perform the test by demonstrating a portion of the test. Byron was able to keep his balance during the instructional stage and did not move his feet from the position he was instructed to maintain. I completed giving the instructions by telling Byron to keep his eyes down on his feet, count his steps out loud, keep his hands by his side, and not to stop until the test was complete. I told Byron that he could begin and observed that he missed heel to toe and made an improper turn by not pivoting on his front planted foot and just turned around. I assessed a total of two out of eight clues for the Walk and Turn test.

I instructed Byron how to perform the One Leg Stand Test by demonstrating the proper position he should take. I explained that he should keep his eyes on his foot, count out loud as instructed, keep his hands down by his side, and keep his leg straight throughout the test. I instructed Byron that he could begin and activated the stop watch on my cell phone to time the passing of 30 seconds. I observed that Byron did not raise his arms out to the side for balance, did not swayed from side to side, did not hopped, and that he did not to put his foot down in order to keep his balance. I assessed a total of zero out of four clues for the One Leg Stand test.

I placed him under arrest and I immediately read him the Georgia Implied Consent Notice for suspects 21 and older from the card that I carry in my pocket, (DDS-354), which I began to use on 07-15-2024. I asked Byron for a sample of his blood and he stated that he would give consent to be tested. Byron was patted down for any contraband and transported by Deputy Burch (Badge# 219) to the Spalding County Jail.

At approximately 1039 hours, Medical Staff [REDACTED] did the blood draw on Byron’s right arm, filling two vials. The blood kit was placed into an evidence locker to be sent off and tested.

I provided Byron Corbett with three citations for failure to yield at an intersection (Citations# E25014), driving while license is suspended (Citations# E25015), and DUI Less Safe (Citations# E25016).

A GEARS report was done in reference to the accident.
