Officer’s Narrative:

On June 30, 2023 at approximately 2130 hours, I responded to the Gas Station at 3425 Jackson Road in reference to a possible drunk driver. When I arrived on scene, I pulled in behind the vehicle and the driver began to pull out of the gas station. I proceeded around the pumps, near the entrance and stopped the vehicle. My Dash-camera was recording during the entire incident. My Body-worn camera died part of the way through.

The witness and complainant, Mr. [WITNESS #1], stated that the driver was going North on North McDonough Road and was driving all over the roadway. Due to the driver failing to maintain lane the entire length of McDonough Road, he called 911.

The driver, Mr. Christopher Gilliam, backed his vehicle up to park his jeep. As I approached his car he got out of the vehicle and tried to separate himself from the vehicle. I asked if he was okay and if he had been drinking and he stated he was fine, and has not been drinking. I asked if he would perform some test and he stated yes.

Horizontal Gaze Nystagmus (0/6) no vertical

The subject was placed on a flat surface, clear of debris. All forward facing strobe lights were turned off for the test. I asked the subject if he had to wear contacts or glasses and he stated he does wear glasses, but doesn’t have them on.

I asked if he had any medical issues and he didn’t answer. I asked about possible concussions, head trauma etc., and the subject stated he went to the hospital earlier in the day but didn’t specify what they said happened. While checking the eyes, the subject would not focus on the stimulus, which was my finger against a light, emitting a red glow. Due to the subject not focusing on the stimulus after multiple passes, nothing was found.

During this test, I noticed that the driver could not stay still and had heavy, droopy eyelids.

Walk and Turn (4/8)

I had the driver remove his shoes, due to him complaining about the crocs he was wearing. The ground was flat and no debris. I placed the subject into the starting position and began to explain and demonstrate the test. The subject had to be told multiple times how to stand and to wait until I finished the instructions. After explaining the test the subject did the following. Incorrect number of steps, improper turn, paused to regain balance and stepped offline.

During this test, I noticed that the subject had extreme body tremors and droopy eyelids.

One Leg Stand (1/4)

I had the driver enter the starting position and attempted to have him stay still while I explained the test. The subject attempted to start the test prior to being told to. Once the test was explained and demonstrated, the subject began the test. He reached 25 seconds, in 30 seconds of time. The subject put his foot down. I had to explain the test multiple times in order for him to comprehend the instructions.

Modified Romberg Balance

During the Modified Romberg Balance, I had the subject stand in the starting position. I explained the test to the subject. While the subject was performing the test, I noticed that the subject showed signs of body-tremors, eyelid tremors, and perspiring. The subject estimated the passage of 30 seconds in 30 seconds.

Finger to Nose

During the Finger to Nose test, I had the subject stand in the starting position and explained the test to him. On pass one, I stated left. The subject moved his left hand in a high arcing motion and hovered over his nose. He then touched to tip of his nose with the pad of his finger. I had to re-instruct the subject to place his hands back at the starting position.

On pass two, I stated right. The subject once again attempted a high arcing motion, and failed to touch the tip of the nose with the tip of the finger. Using the pad of his finger he touched the bottom of the nose. The subject was instructed to place his hand back at the starting position.

On pass three and four, the subject did not perform a high arcing motion. The subject failed to touch his finger tip, to the tip of his nose. The subject began moving his arms back down on his on, on the fourth pass. On pass five and six, the subject missed the tip of the finger and tip of the nose.

Due to above test, I believe that the subject is under in the influence of an impairing drug. The driver attempted to call the hospital, Grady, in order to get a list of medication he was given. The hospital would not release that information, but the medical staff did say that he was told not to drive and they told him not to leave the hospital.

I placed the driver in custody for DUI Drugs. He was handcuffed behind his back, double-locked and checked for fit. I secured him into my backseat and attempted to allow him to call a someone to get his vehicle. His aunt answered but said she does not have anyone else home to bring her to retrieve it.

Due to the DUI Drug case, I asked an assisting Deputy, Deputy Ramsammy, to inventory the vehicle and do a tow-slip. He stated okay. I read implied consent and asked for blood. The drive refused. I transported the subject to Detention and obtained a search warrant for blood signed by Judge MacDowell. The subject refused the search warrant.

Deputy Ramsammy called me and informed me that the following items were found.
– Xanax (20 pills)
– Crystal like substance that resembled meth
– THC Vape pens (Delta 10)

I read Miranda and asked if the subject would speak and he stated yes. I asked about the drugs and he stated he doesn’t smoke crack and doesn’t know about Xanax. I asked if he was prescribed medications and he stated yes, he took Klonopin. I asked if he smoked marijuana and he stated yes. I asked about the vape pens and he admitted they were THC pens but they were legally sold at vape shops.

The driver was booked on the following charges.
– Possession of Schedule II : 23-EW-003370
– Possession of Schedule IV : 23-EW-003371
– DUI Drugs : 23-EW-003372
– Failure to Maintain Lane : 23-EW-003373
– Pills Not in Original Container : 23-EW-003374
– Obstruction of LE : 23-EW-003375
The backseat was checked and nothing found.
