On 06/03/2025 I, Deputy H. Clark, responded to a fight in progress on 2010 North Expressway in non-emergency mode. As I arrived, I activated my body-worn camera.
As I arrived, I spoke with [VICTIM #1] (/2004 B/F), who stated that her boyfriend, Berry Illay (/2003 B/M), had started punching and kicking her to the ground. [VICTIM #1] stated that she and Berry were lying down watching TV when she asked him if he was having sex with another woman. [VICTIM #1] stated that Berry stated that he said no the first time and stated that when she asked Berry for the second time, that’s when he began to get upset.
[VICTIM #1] stated that Berry had thrown an ashtray and began to beat her. [VICTIM #1] stated that she was trying to calm Berry down, asking him to stop hitting her. [VICTIM #1] stated that Berry had punched and kicked her multiple times, causing bleeding and bruises on her body. [VICTIM #1] stated that she tried to leave the hotel room, but Berry had begun blocking the door, striking her in the face multiple times. [VICTIM #1] stated that when she attempted to call the police, Berry had grabbed her phone and smashed it.
Due to having multiple witnesses around the area, I was able to get witness statements from each individual who witnessed the incident. I was able to speak with [VICTIM #2] (/1990 B/M), who stated that he witnessed the incident and tried to break the altercation up. [VICTIM #2] stated that he was walking back to his room and heard [VICTIM #1] yell and scream for help in her hotel room. [VICTIM #2] stated when he heard [VICTIM #1] yell, he ran to the door. [VICTIM #2] stated that when he got to the door, Berry had opened the door and hit him in the face. [VICTIM #2] stated that after he hit him in the face, they began to fight, and that’s when Berry was able to break free from the fight and run off.
I spoke with [WITNESS #1] (-2000 B/F), who stated that while she was in room [REDACTED], she was about to get in the shower when she heard [VICTIM #1] yell, “Get off me! Someone help me!” [WITNESS #1] stated when she heard [VICTIM #1] yell, she ran over to try and help, but due to the altercation, she stated that she grabbed the baby to prevent the baby from getting hurt.
I was able to speak with [WITNESS #2] (/1989 B/F), who stated that when she came outside, she heard [VICTIM #1] and her baby crying. [WITNESS #2] stated she witnessed two men fighting and observed [VICTIM #1] walk out of the room crying and bleeding.
EMS arrived on the scene and was able to evaluate [VICTIM #1] for her injuries. I was gathering information from EMS about [VICTIM #1]’s injuries. [VICTIM #1] advised that during the altercation, Berry had pushed her 1-year-old son„ to the ground. I was able to observe the bruises and markings from the incident. I was able to obtain pictures.
After gathering all the information from the victim and witnesses, I placed Berry under arrest. I placed Berry in handcuffs and double-locked them I checked my back seats for contraband placed Berry in my patrol vehicle and transported him to the detention center. After turning him over to the jail staff I checked my back seat for contraband and located none.
I have no further information at this time.
