On May 7th, 2026 I, Deputy M. Ruthosky responded in non emergency mode to [600 BLOCK] Parham Road, Griffin GA 30223 in reference to a domestic in progress.
Dispatch had advised that the female caller Mamie Banister (W/F /1954) stated that her husband [VICTIM #1] (W/M /1944) is not in his right mind and that he pulled a gun on her. Mamie had left the residence and was sitting in her car. I advised dispatch to advise her to meet with me at Ring Golds Grocery located at 4243 Jackson Road, Griffin GA 30223.
Mamie arrived at Ring Gold Grocery and I made contact with her. Mamie stated that [VICTIM #1] had a knee surgery a few weeks ago and has not been acting in his right mind since. Mamie added that when [VICTIM #1] had knee surgery sometime last year a similar thing had happened and that they had to fix his medicine. Mamie stated that [VICTIM #1] had mental issues and when asked what kind she stated Bipolar and he takes anti depressants.
Mamie stated that she had taken [VICTIM #1]’s pain medicine away and stopped giving it to him. Mamie stated that she did not want him taking it due to it being a narcotic. She stated that they had went to the doctor today and sometime after they came home [VICTIM #1] had fallen. Mamie stated she attempted to help him up but couldn’t. She then added that she had him crawling around on the floor for approximately 2 to 3 hours, and that he was currently still on the floor. Mamie stated [VICTIM #1] has been acting paraniod and not in his right mind. She stated she was sitting in the living room and [VICTIM #1] was on the floor and he stated I need you to look at me. Mamie stood up and she stated that’s when he pointed the gun at her. Mamie stated that the gun was kept by the fireplace and was unsure if he still had it in his possession. Mamie stated he has never gotten this bad. When asked about possible dementia Mamie stated that she thinks [VICTIM #1] could have on set dementia.
I then went to the residence at [600 BLOCK] Parham Road to speak with [VICTIM #1]. When I arrived [VICTIM #1] could be seen through the front windows next to the front door laying on the floor covered with blankets. I made entry into the home and [VICTIM #1] was detained. [VICTIM #1]’s immediate area was searched and a 22 Winchester Magnium (SN# 815-12426) loaded with 9 rounds was located in a zipped bag on the fireplace. The gun was cleared and ran through GCIC/NCIC and came back with no record.
[VICTIM #1] stated that Mamie does not take care of him. [VICTIM #1] stated that she gets upset trying to help him up when he falls and then makes him crawl around on the floor for hours. [VICTIM #1] stated that he has not eating in over 24 hours and was cold due to the air being turned down. [VICTIM #1] stated that he was telling Mamie he was hungry and cold when she left. [VICTIM #1] stated that the way Mamie treats him feels inhuman and that she does not help him.
Spalding County EMS med unit 4 and fire was advised the scene was safe and made entry into the home. EMS and Fire checked [VICTIM #1]. [VICTIM #1] had knee surgery on his right knee. On his left knee an abrasion was visible and fresh. EMS advised it could be due constant pressure and friction caused by crawling on the knee. [VICTIM #1] stated it was from a dog. Five EMS and Fire employees assisted [VICTIM #1] in getting into his wheelchair. [VICTIM #1] also had a clear container next to him where he had been urinating.
[VICTIM #1] showed his medicine and EMS advised they were non narcotic. [VICTIM #1] stated that he takes his medicine out of a weekly medicine container. The medicine container was empty for monday and tuesday but had medication in it for Wednesday-Sunday. [VICTIM #1] refused medical treatment and being taken to the hospital.
Mamie was asked where the medication was that she had taken. Mamie advised it was in the kitchen in the second drawer with her medication so [VICTIM #1] couldn’t take it. I found the medication where Mamie stated it was. The medicine was Oxycodone 10mg. It was filled on 04/22/2026 with a quanity of 24 pills. There were 10 pills in the bottle. EMS confirmed that those pills were not in [VICTIM #1]’s daily medicine container.
Mamie was sitting in her car in the driveway and was asked to step out of the vehicle. Due to physical evidence and verbal testimony Mamie was then placed in handcuffs, checked for fit, doubled locked and placed under arrest. Mamie was read her mirandia rights and she advised she wished to speak with me. Mamie was asked why she took away [VICTIM #1]’s medication. She stated that she did not want him taking to many and overdosing and she felt as if he did not need to be taking the medication. Mamie was asked if she had medical training or a doctorate. She advised she did not. Mamie was then asked why she left [VICTIM #1] on the floor for hours and did not call for help. Mamie stated she tried to help him up, and that he forgets he can do things by himself and that if he wanted to get up he was able to.
Mamie was placed in the back of Deputy H. Dix patrol car and transported to the jail where she was turned over to jail staff.
[VICTIM #1] was asked if there was anyone we could call to take care of him he advised his son [REDACTED] could. I made contact with [REDACTED] and advised him of the situation. [REDACTED] stated that he would come by and check on his dad but was unable to provide steady care for him. In the home there was paperwork filled out for assisted living, but [REDACTED] was unsure of the status of the request. [REDACTED] was advised that a Adult Protective Service report would be made and he advised that to be best.
I gave [VICTIM #1] his phone and a phone charger and advised him to keep it close and that if he needed any help to call 911.
Photos have been added to the case file at this time, and a APS report has been completed.
The following warrant has been obtained through the Magistrate Court of Spalding county on Mamie.
