On September 18th, 2022, at approximately 00:10 hours, I was conducting traffic enforcement on I-75 northbound in Tift County, Georgia. I observed a grey Ford SUV failed to maintain its lane. I conducted a traffic stop on the vehicle. While speaking to driving I smelled a strong odor of an alcoholic beverage coming from inside the vehicle. I asked the driver to step to the front of my vehicle.

I identified the driver to be Ryan Tyler Brown by his Georgia Driver License. While I was speaking with the driver, I smelled an odor of an alcoholic beverage emitting from his breath. I observed his eyes were bloodshot and watery. I asked the driver how much he had to drank and he stated one cup. I asked Mr. Brown, if he would consent to field sobriety, he agreed.

After medically clearing the driver, I positioned him in front of my patrol vehicle on a flat, paved, surface free from obstructions to perform the Horizontal Gaze Nystagmus portion of field sobriety. The driver’s eyes were bloodshot and watery. I observed the driver’s pupils were equal in size and showed no signs of resting Nystagmus. I observed 6 clues.

Next, on the Walk and Turn, I positioned the driver in front of my patrol vehicle on a flat, paved, surface free from obstructions. I explained and demonstrated the evaluation. Mr. Brown stated he understood. During the instruction phase Mr. Brown was unable to keep his balance, he raised his arms for balance. During the walking phase Mr. Brown missed heel to toe. I observed 3 clues.

Last, on the One Leg Stand, I positioned the driver in front of my patrol vehicle on a flat, paved, surface free from obstructions. I explained and demonstrated the evaluation. I observed the driver to sway and raise his arms for balance. Mr. Brown also put his foot down. I observed 3 clues.

I asked for a preliminary breath sample using my Alco-Sensor FST. Mr. Brown agreed. The reading was positive with a display of 0.139. I placed the driver under arrest for Driving Under the Influence. I read Mr. Brown the Georgia Implied Consent Notice for Suspects Under age of 21, requesting blood, and the driver agreed. I placed the driver in the rear of my patrol vehicle.

The vehicle was towed and stored at Whites Towing. I transported Mr. Brown to Tift Regional Hospital. Nurse [REDACTED] drew blood from the left arm at 00:53 hours. I then transported Mr. Brown to the Tift County Jail and turned him over to jail staff for processing. Mr. Brown was charged with Driving Under the Influence, fail to maintain lane, and due care. The blood kit was turned into Post 13 to be sent to the GBI for testing.
