On June 2nd, 2023, around 11:29 P.M., I, Deputy Perry, was traveling on Interstate 16 East near Mile Marker 28 when I observed silver in color Toyota Camry displaying the Georgia License Plate “[REDACTED]” that was traveling in the left hand lane failing to maintain its line by driving over the striped lines in the center of the roadway, as well as weaving back and forth within it’s lane.
I ran the tag through GCIC on my mobile data terminal, and was advised that the registered owner of the Toyota Camry, Ms. Jade Clemons, had a suspended driver’s license. I then got directly behind the Toyota Camry and turned on the blue lights in my patrol vehicle to conduct a traffic stop around Mile Marker 29.5.
At first, the Toyota Camry showed no indications of braking or stopping, but eventually began rolling while lightly holding it’s brakes. The Toyota Camry then got over in the emergency lane and continued rolling while lightly holding it’s brakes until it reached my partner, Corporal Fox, who was currently conducting a traffic stop at Mile Marker 30. The Toyota Camry then came to a complete stop.
Immediately after stopping, I could see a lot of movement inside of the Toyota Camry. I then saw the rear end of the Toyota Camry suddenly sink down, as if someone jumped in the back seat area. I then saw the silhouette of a person’s head and upper body jump from the front passenger seat to the driver’s seat. I requested for Corporal Fox to assist me when he completed his traffic stop.
I approached the Toyota Camry from the passenger side. Once at the Toyota Camry, I observed the front passenger seat was leaned all the way back, and that the seat belt was still buckled in. I also observed Ms. Jade Clemons sitting in the driver seat and a white male laying in the back seat area as if he was asleep.
I introduced myself to the occupants as “Deputy Perry with the Twiggs County Sheriff’s Office” and asked both occupants for their identification. Ms. Clemons began fumbling through compartments in her vehicle and the white male advised that he did not have any identification on him.
I then advised Ms. Clemons and the white male of all of the movement that I observed inside of the Toyota Camry prior to walking up, and asked if they switched seats, both of which replied that they did not. I asked why the front passenger seat was leaned back and the seat belt was still buckled, but could not get a sensible answer.
I asked both Ms. Clemons and the white male if they would step out and advised that I would identify them by their name and date of birth. Both Ms. Clemons and the white male had a hard time following instructions and had to be asked multiple times before complying. Once Ms. Clemons and the white male stepped out of the vehicle, the white male identified himself as “Micah Brown” born on [REDACTED] and I retrieved a driver’s license from Ms. Clemons.
While speaking with Ms. Clemons and Mr. Brown outside of the Toyota Camry, I noticed that their speech was slow and slightly slurred as if they were intoxicated, but I did not smell any alcohol. I also noticed that Ms. Clemons sounded very congested in the nose. I advised Ms. Clemons and Mr. Brown that I would return shortly and asked if they would stay where they were for the moment.
I returned to my patrol vehicle where I ran Ms. Clemons’ and Mr. Brown’s identification information through GCIC on my mobile data terminal. While doing so, Corporal Fox parked his patrol vehicle behind mine and assisted me. After running Ms. Clemons’ and Mr. Brown’s information through GCIC, I confirmed that both Ms. Clemons and Mr. Brown were both currently suspended.
I stepped out of my patrol vehicle and asked Mr. Brown and Ms. Clemons if they were going to be honest with me about switching seats. Mr. Brown and Ms. Clemons still advised me that they had not. I then advised both Mr. Brown and Ms. Clemons that both of their driver’s license were suspended, and that I was placing both of them under arrest for driving on a suspended license.
Corporal Fox began placing handcuffs on Mr. Brown while I began placing handcuffs on Ms. Clemons’ wrists, both of which who were being passive resistant and wanted to argue. I had to tell Ms. Clemons multiple times to turn around and allow me to place handcuffs on her wrists before gaining any compliance.
Mr. Brown then openly admitted that the two switched seats, and pleaded for me not to arrest Ms. Clemons. I then advised Mr. Brown that the opportunity for honesty was over due to me asking multiple times about the situation and being lied to by him and Ms. Clemons. I had Ms. Clemons sit in the back seat of my patrol vehicle and Mr. Brown sit in the back seat of Corporal Fox’s patrol vehicle.
I then called for a wrecker and began conducting an inventory of the Toyota Camry. I began my inventory from the front driver side of the Toyota Camry, where I immediately located a small blue in color ziploc bag containing residue in the floorboard of the front driver seat. Corporal Fox and I now began a search of the vehicle due to the suspected drug related item in the front driver seat floor board.
While searching the front side of the Toyota Camry, Corporal Fox and I located multiple straws containing a white powdery residue in areas such as compartments in the dash board and in the floorboards of both seats. I also located an identical blue ziploc bag containing a single round blue in color pills with and imprint of “M” on one side and “30” on the other, which is an Oxycodone pill from the pharmacist but is commonly pressed on the streets to pass and as Oxycodone pill but is laced with other substances.
I also found approximately half of an identical pill in a compartment directly in front of the center console, as well as what looked like crushed up pills at the bottom of the center console that I could not retrieve. While searching the back seat area, I located a small, green in color, unmarked plastic container, that contained approximately 84 and a half more pills that were identical to the ones located in the front seat area of the Toyota Camry.
In the trunk there was a grinder containing a small amount of a green leafy substance suspected to be marijuana, as well as another straw containing a white powdery residue located inside of a female purse. I returned to my patrol vehicle where I advised Ms. Clemons of her Miranda Rights. Ms. Clemons advised me that she would like to speak with me. Ms. Clemons advised that she had no knowledge of the pills that were located inside of the Toyota Camry.
I then approached Corporal Fox’s patrol vehicle where I advised Mr. Brown of his Miranda rights. Mr. Brown advised that he would like to speak with me. Mr. Brown advised that the pills, as well as everything else illegal inside of the Toyota Camry belonged to him, and that he did not inform Ms. Clemons of them until right as I was pulling them over. I then informed Mr. Brown of implied consent. Mr. Brown gave consent to a blood draw.
I returned to my patrol vehicle once more where I advised Ms. Clemons that I was under the impression that she was under the influence of the pills located due to her actions and behavior. Ms. Clemons congestion was also a sign of possible drug usage through the nose, consistent with the amount of straws containing white powdery residue located inside of the Toyota Camry.
I informed Ms. Clemons of implied consent. Ms. Clemons gave consent to a blood draw. I advised Ms. Clemons that Mr. Brown took full ownership of the pills, but that I was still charging her for DUI and driving while her drivers license was suspended. Corporal Fox transported Mr. Brown to the Twiggs County Jail while I remained on scene with Ms. Clemons and her vehicle.
Once the Toyota Camry was removed from the scene by Brown’s Wrecker Service, I transported Ms. Clemons to the Twiggs County Jail. It was later discovered that Mr. Brown was currently wanted out of College Park for motor vehicle theft, and that he has previous charges of DUI Drugs. All evidence was turned in to the Twiggs County Sheriff’s Office Evidence Drop Box.
