[NARRATIVE #1 on December 28, 2022]

On 12/28/2022, at approximately 1500 hours, I responded to Highway 27 at Wheeler Road, in reference to GSP requesting assistance with the listed arrestee. I arrived on scene and GSP advised me that it was a rolling domestic disturbance.

GSP advised that the listed arrestee had been yelling at the listed victims and hit the listed victim, ([VICTIM #1]). I made contact with the listed victim, ([VICTIM #2]) who advised me that the arrestee had been aggressive towards them both and at one point threw the victims, ([VICTIM #2]) phone into the front of the car and hit victim, ([VICTIM #1]) on the shoulder.

At this point, I made contact with the victim, ([VICTIM #1]) who advised me that he has a history of being loud and aggressive towards them. At this time, I took the arrestee into custody without incident.

While en route to the Walker County Jail, the arrestee began shouting at Deputy Fouts “you just a blind b*tch a p*ssy Im gonna have your job you crossed eyed mother f*cker” he then stated “Im gonna file a sexual harassment claim on you” he then headbutted the partition in the patrol car resulting in a laceration across his forehead, that started to bleed.

Upon arrival at the jail, medical personnel attempted to check on the subject, at which point, he became very belligerent, stood up and turned fast. While Deputy Fouts was attempting to regain control of the subject he fell and struck his head on the ground.

Due to the wound bleeding more, the arrestee was transported to CHI Memorial.

On 12/28/2022 I responded to CHI Memorial Hospital due to listed other becoming combative again.

[NARRATIVE #3 on December 28, 2022]

On 12/28/2022, I responded to Hwy 27 and Wheeler Rd in reference to assisting GSP Trooper Mitchell with a traffic stop that he was on. When I arrived on scene he advised Deputy Jacobs that a rolling domestic had occurred prior to his stop and requested that Deputy Jacobs investigate the domestic.

After Deputy Jacobs investigated the domestic he found probable cause to arrest the suspect. The suspect was searched and placed in the back seat of my patrol vehicle for transport to the jail. I searched the back seat of my patrol vehicle and nothing was found. I then transported the suspect to the Walker County Jail.

While en route to the Walker County Jail the suspect became very irate yelling profanities and verbal assaults at me. He stated that he was going to file a sexual assault complaint against me and that “I needed to make as much money as I could now” because he was going to have my job. He then headed butted the partition causing a gash in his forehead. I radioed to the jail asking if they had medical personnel on duty and they advised that they did.

Due to the level of intoxication of the suspect and where the gash was it was bleeding profusely. I sped up to get to the jail as fast as I could. The suspect after headbutting the partition then began to cry about what he had just done and stated “help me I’m leaking.” The suspect continued to yell at me from the back seat stating that he was “going to file sexual harassment charges on you mother fickler.”

He then again claimed he was leaking and called me a “b*tch.” He then stated “yeah I may have been drinking and I may be a little drunk but I never touched her.” He then stated that I was about the stupidest police that he had ever seen in his life and that he was going to get me for sexual harassment then called me a “cross eyed son of a bt*ch.”

We then got out at the jail. I got him out of the vehicle and began walking him into the gun doors. When we made it inside of the outer gun door but not into the inside gun door the suspect stated that if he sees me out without a badge on he had me. I took this a threat against my safety and advised him that he just received another charge due to it being witnessed by at least two other people.

We then walked him into the booking area where intake was completed and he was then sat down so medical could look at the gash on his forehead. He became very irate when medical attempted to look at the wound jumping up and turning aggressively towards me. He was still in handcuffs at this point so I grabbed a hold of the suspect and attempted to lower him to the ground.

The suspects head hit the ground but I was able to regain control of the suspect. I placed my knee on the handcuffs in the small of his back so he could not move his hands and my left hand on the side of his head and called medical over while detention put leg irons on him. I instructed detention how to properly restrain his feet while he was trying to resist that and he was held down while the bleeding was assessed and controlled. Nurses at the jail determined that the gash was to severe and that EMS needed to be called to treat the suspect at the hospital.

The suspect was transported via ambulance to CHI Memorial I followed behind the ambulance and a detention officer behind me. Deputy Jacobs rode in the ambulance and stayed with the suspect until the detention officer could get to the hospital to relieve him and I could pick him up.

A use of force report was completed.
