[NARRATIVE #1 on September 11, 2023]

On 9/11/2023 at 11:19 hours, I was dispatched to the listed incident location in reference to a violation of a TPO.

I arrived on scene and met with the listed victim, who stated stated she had been at the dentist earlier this date and upon returning home stated she observed her husband’s truck parked on Raydine Lane, 4 houses away from hers. She currently has a TPO against her husband, the listed suspect, and the TPO stated he is not to be within 150 yards of her residence. The victim stated the suspect had been mowing yards in the area and took the job at the house on Raydine to harass her.

I checked the TPO paperwork, and verified that it had been issued on 8/24/2023, and did state the 150 yard restriction. Deputy Avans #48 served the TPO, #23SUCV0583 on the suspect on 8/24/2023 I observed the suspect’s vehicle was parked in the roadway approximately 80 yards from the victim.

I made contact with the suspect at [1300 BLOCK] Raydine Lane, and he stated he had been told by Deputy Avans that he could be no closer than 3 houses from the victim. I explained that the court order stated he could not be within 150 yards of the victim and that he was well within that distance. The suspect agreed he was probably closer than the order stated, but insisted he was told he could be there.

The suspect was placed under arrest for the listed charges, and secured in handcuffs which were checked for proper fit and double locked. Prior to placing the suspect in the rear seat of my vehicle, I checked both for weapons or contraband with nothing found.

The suspect was transported to the Walker County A/B sector line where he was turned over to Deputy Maroon for transport to the jail.

I spoke with Deputy Avans by phone regarding this incident, and he stated he had advised the suspect on 8/24/23 to contact the Superior Court Judge regarding the order to inquire about an exception if he would be working in the area.

The victim was provided the case number for this report, no further action taken.

Prior to placing him into the rear seat of my patrol car. The rear area of my vehicle was searched for weapons and contraband, which there was none found.
