On listed date a time, dispatch advised over the radio of a be on the lookout for a red pickup truck.
Dispatch advised [REDACTED BY AGENCY] stated Mr. Kushman in the pickup truck had pointed a gun at her and was traveling north on Highway [REDACTED BY AGENCY] near Cedar Lane.
I advised dispatched I was enroute. I advised dispatch to remain on the line with [REDACTED BY AGENCY] if they could. Dispatch kept me updated on vehicles location. As Mr. Kushman’s vehicle approached the intersection of Highway 193 and Highway 2, I activated my emergency lights and conducted a traffic stop.
I advised dispatch to have [REDACTED BY AGENCY] vehicle pull into the Mapco Gas Station at that intersection.
Once Mr. Kushman’s vehicle came to rest, I approached Mr. Kushman’s driver side and noticed he had both hands out the window. I then asked Mr. Kushman where the firearm was and he stand in the center console. I advised him not to reach for it and step out of the vehicle, he did. Deputy Hinch #45, arrived on scene to assist.
I advised Mr. Kushman to step to the rear of his vehicle and stand with deputy Hinch #45. I then searched the center console where Mr. Kushman advised the firearm was and discovered a [REDACTED BY AGENCY] handgun. I seized the handgun and advised dispatch of the serial number [REDACTED BY AGENCY]. Dispatch advised it returned not on file. I placed the handgun in the passenger seat of my patrol car for safety.
I approached Mr. Kushman and deputy Hinch #45. Deputy Hinch #45 advised me Mr. Kushman willfully admitted he did wave the gun out the window at [REDACTED BY AGENCY] during the altercation. I advised Mr. Kushman to turn around and placed handcuffs on Mr. Kushman’s wrist, behind his back. I checked for tightness and double locked the handcuffs and advised Mr. Kushman he was detained at this tie.
Deputy Hinch #45 stayed with Mr. Kushman, while I went to speak with [REDACTED BY AGENCY]. Upon speaking with [REDACTED BY AGENCY] I asked if she could fill out a witness statement and she stated yes. While doing so I asked if the juvenile in the car witnessed anything take place. She stated she did not see anything but everything that was going on.
I then observed the witness statement and [REDACTED BY AGENCY] advised, she stopped by [REDACTED BY AGENCY] at Highway 193 and Highway 136 West to get her and the juvenile breakfast. She state when she went to leave she got behind Mr. Kushman vehicle and Mr. Kushman vehicle began brake checking her. She then advised Mr. Kushman began throwing drinks out of his window. She stated she pressed her vehicle horn and that when Mr. Kushman held a gun out the window and yelled for her to pull over. She stated she then backed off Mr. Kushman vehicle and took a picture of his tag, then called 911.
Based on Mr. Kushman’s willful commission and [REDACTED BY AGENCY] statement, Mr. Kushman was placed under arrest at this time, for aggravated assault (16-5-21(a)(2)), possession of a firearm during the commission of a crime (16-11-106(b)(1)), and aggressive driving (40-6-397).
I then went back to Mr. Kushman’s location. Next list tow company [REDACTED BY AGENCY] was contact by dispatch to retrieve Mr. Kushman vehicle. An inventory was taken for Mr. Kushman vehicle to document valuable items in the vehicle. While doing so a [REDACTED BY AGENCY] magazine was discovered behind the center console. The magazine contained fifteen rounds of 9mm ammunition. A holster was also discovered in the center console.
All items plus the handgun were seized for evidence. Mr. Kushman was then escorted to the passenger rear of my patrol car and search due to incident of arrest, no contraband was found. Mr. Kushman was then assisted into the patrol car. [REDACTED BY AGENCY] then arrived on scene. Deputy Hinch #45 remained with the tow truck and suspect vehicle.
I transported Mr. Kushman to the A-B line, where I met with deputy McNichols #78. Mr. Kushman was turned over to deputy McNichols #78 to transport to the Walker County Jail. The back seat of my patrol car was checked for contraband before and after transport, none was found.
An evidence form was completed and all items were turned into the evidence custodian.
