On 9/13/2025 at 20:22 hours I, Officer Henry, was requested to be en route to 2643 N Hwy 27, LaFayette in reference to a fight at El Trio Mexican Restaurant. Upon my arrival I made contact with Tanner Stapp (listed suspect). While speaking with Mr. Stapp in the parking lot, he advised me of the incident.

Mr. Stapp advised that he had heard his friend who lived with him was eating at this restaurant with his Ex. Mr. Stapp stated that he drove to LaFayette from Dalton, Ga and located the vehicle of [REDACTED] (listed other) at the El Trio Mexican Restaurant. Mr. Stapp then entered the restaurant to take a phone back from Mr. [REDACTED]. When making contact with Mr. [REDACTED], Mr. Stapp advised he stated “Give me the Phone”. Mr. [REDACTED] stood up and They both had each other by the neck. AT this time Mr. Stapp advised that an unknown bystander in the restaurant grabbed him and escorted him outside before things got worse.

I then spoke with Mr. [REDACTED], who advised the same, stating that Mr. Stapp reached for his phone, so he stood up at the table he was eating at and Mr. Stapp grabbed him by the neck. Mr. [REDACTED] stated he then grabbed Mr. Stapp by the neck and it was quickly broken up by a bystander. Mr. [REDACTED] stated he did not wish to press charges and that it was not an actual fight just a situation that got out of hand in public.

Based on the statements of both parties and due the incident evolving so quickly in a crowded restaurant I placed Mr. Stapp under arrest for the City Offense of Disorderly Conduct. Mr. Stapp was placed in handcuffs, which were checked for fit and double locked. I searched Mr. Stapp for any weapons or contraband, which none were found. I then searched the rear of my patrol vehicle for any weapons or contraband, which none were found. I secured Mr. Stapp in the rear of my patrol vehicle and transported him to the Walker County Detention Center. Once at the detention center, Mr. Stapp was turned over to detention staff and I returned to service.
