On 06/08/23 at approximately 0046 Hours I, Ofc. Kitchen responded to an attempted rape at [500 BLOCK] Craver Pl. While I was en route to [500 BLOCK] Carve Pl. units were advised that the suspect was a subject named Garfield and that he had left the location in a red in color pick up truck and lives in the area of Maple Ln, other units were able to find the vehicle and make contact (See Supplemental reports).

I continued to Carve Place to make contact with the complainant and the victim, upon my arrival there was a group of people out in the front of the apartment and figured out who was who in the group. Sgt. Scruggs separated the victim and went inside and spoke with her while I ascertained relations to parties at the residence before going inside and speaking to the victim’s mother ([REDACTED]) and the other party inside the residence ([WITNESS #1]) at the time the incident occurred.

I spoke with the subject who resides at [500 BLOCK] [WITNESS #1] about what had occurred, [WITNESS #1] said that she had invited Garfield over to her residence to try and fix her speaker system so that it would work with the TV audio. [WITNESS #1] said that she was inside her bedroom and was not in the living room area when the event occurred so she was unsure of what actually took place other than what the victim ([VICTIM #1]) had told her over text and in person.

I asked how [WITNESS #1] knew the Garfield subject and she said that he was her children’s godfather. [REDACTED] was not on location when the incident occurred but was able to provide to me after questioning that [VICTIM #1] was over hanging out [WITNESS #1] due to [WITNESS #1] being in a relationship with [VICTIM #1]’s brother. [WITNESS #1] did state when I asked about the relationship between the two that [WITNESS #1] is [VICTIM #1]’s sister in law.

I gathered the two’s information and around this time Sgt. Scruggs had finished his questioning of [VICTIM #1] and stepped outside to speak with CID and I went and spoke with [VICTIM #1]. Prior to speaking to [VICTIM #1], I obtained her information and then had her go over the incident with me as well, she stated that she was over at the residence and that the Garfield subject had come over to help [WITNESS #1] with her speaker.

She said that she had left the living room area due to her not being familiar with Garfield and [WITNESS #1] was on the phone with her brother due to him being incarcerated. [VICTIM #1] then said that she was unaware that Garfield had left the living room and had followed her towards the back of the residence. [VICTIM #1] said that Garfield while following her had begun to rub her genital area.

[VICTIM #1] said that after this occurred she had gone into the closest room to her and shut and locked the door keeping Garfield out. [VICTIM #1] then said that Garfield had begun to bang on the door and told her that he wanted to say goodnight to her. [VICTIM #1] said that she did not open the door for Garfield and then began to text [WITNESS #1] about the incident.

[VICTIM #1] said that she did not open the door at all until Garfield had left the residence. [WITNESS #1] again said that she was unaware of what was happening/had happened until she was tented by [VICTIM #1]. I was able to find out through Sgt. Scruggs that [VICTIM #1] said that Garfield did have a handgun on his person that she had seen throughout the incident but she did not state if Garfield at any point presented it during the assault.

Due to [VICTIM #1] being a juvenile [REDACTED] was asked if she wished to press charges which she did want charges pressed for the assault. I also inquired about them doing a forensic interview with the Child advocacy center and [REDACTED] did seem interested in conducting one. CID was contacted and provided with all information needed pertaining to the assault, Garfield was placed under arrest for sexual battery and taken to WCSO by Ofc. Parson.
