On August 16, 2023, at approximately 0003 hours I, Cpl. Robertson was setting in the parking lot of Graystone Church looking for traffic and equipment violations traveling on North Broad Street (Ga. Hwy. 11) I observed a dark red in color SUV traveling south on North Broad with a tag light violation.
I pulled out of the parking lot of Graystone Church onto North Broad Street to conduct a traffic stop on the vehicle. While traveling behind the vehicle to catch up I observed that the vehicle was failing to maintain lane. The vehicle hit the center lane with the driver side tires of the vehicle.
I activated my emergency lights to conduct and traffic stop on the vehicle for the tag light violation and the failure to maintain lane of travel and check the driver for possibly driving under the influence. When I activated my emergency lights the vehicle began to speed up and failed to maintain lane of travel.
I advised Sgt. Studdard that the vehicle was speeding up and traveling south on Broad Street at Marable Street. I activated my emergency siren with my emergency lights to try and get the vehicle to come to a stop. The vehicle continued to travel and then accelerated to speeds of 70 miles per hour in a 25 mile per hour speed zone in downtown area of the city of Monroe.
I continued to advice Walton County Communications of my speeds and my locations. The weather was clear roadways were dry and light to no traffic. When we came to the intersection of South Broad Street and Davis Street the vehicle lost control and slide off the roadway and struck a tree and two light poles that are property of the city of Monroe.
The vehicle came back to a position of all four wheels back on the ground. The vehicle had major damage from striking the tree and the two light poles and a blown tire. The vehicle came back onto the roadway and continued to travel south on South Broad Street. I advised Walton County Communication of the vehicle wrecking and then continuing to travel south. I advised Walton County communication that the vehicle was continuing to travel with a flat tire.
Sgt. Studdard advised to let the vehicle continue to travel and once we got to the opening at South Broad Street and the Intersection of South Madison Avenue to pit the vehicle there. I advised Sgt. Studdard to come take the over as lead vehicle due to him having the K-9 and if the subject got out and run on foot he could let the K-9 out to apprehend the subject.
The vehicle made a right turn onto West Vine Street and slowed down so I conducted the PIT at this point due to the speed and location being clear with no danger to the public or property. The PIT was successful and the subject were removed from the vehicle safely without further incident.
The passenger was removed from the vehicle and advised to get on the ground face down and placed in handcuffs checked for fit. She was watched by Officer Arriaza as I went to the Drivers side of the vehicle and removed the driver from the vehicle without further incident.
The driver was advised by verbal commands to exit the vehicle and get face down and place his hands behind his back. He was then hand cuffed and checked for fit. I then assisted the subject up and escorted him to the back seat of my patrol unit where he was secured in the rear seat.
The name of the passenger was [REDACTED BY AGENCY], she was a minor at the age of 16. Her mother’s name was obtained and contact was made by Walton County Communication. I had them transfer the call to my work phone and I spoke with her and asked her if she knew who was driving her vehicle and she stated that it was a subject by the name of Preston Peavy.
She then stated she was just worried about where her daughter was and I advised her that her daughter was with me and she was safe. The mother [REDACTED] was advised that I was going to have an Officer transport her daughter home to her. Officer Arriaza transported [REDACTED BY AGENCY] to her residence in Squirrel Hallow.
The driver Preston Peavy information was given to Walton County Communication to check through GCIC and NCIC to make sure that he had a valid license and no warrants for his arrest. Mr. Preavy came back with a suspended license with a surrender date and with a warrant from the Georgia Department of Parole. The warrant was confirmed out of the Georgia Department of Parole. I advised Walton County Communication that he would have local charges.
The vehicle that Mr. Peavy was driving belong to [REDACTED], she was advised that the vehicle was wrecked and was totaled. The vehicle was released to Taylor Wrecker Service. The vehicle had a light pole under it from where it struck the two light poles around the intersection of South Broad Street and Davis Street.
Preston Peavy was transported to the Monroe Police Department where he was finger printed for the violations of Driving with a suspended or revoked license, Felony fleeing and attempting to elude, Reckless driving, interference with government property, cruelty to children in the 2nd degree. Mr. Peavy was also charged with traffic violation of failure to maintain lane, and an equipment violation for the no tag light.
Mr. Peavy was in violation O.C.G.A. 40-5-121 Driving on suspended or revoked license by operating a motor vehicle on the highways of this state while having a suspended license with a surrender date and knowingly doing so.
Mr. Peavy was in violation of O.C.G.A. 16-5-70 Cruelty to Children in the 2nd Degree by place [JUVENILE #1] in mental and physical harm with criminal negligence by felony fleeing from the police officer, placing her in physical harm’s way.
Mr. Peavy was in violation of O.C.G. A 40- 6-395 Felony Fleeing and Attempting to Elude Officer, when he did attempt to elude the officer and driving in a reckless manner in excessive speeds of 60 to 70 miles per hour in a 25 mile per hour speed zone and placing other people of the public at risk of injury.
Mr. Peavy was in violation of O.C.G.A. Interference with Government Property 16-7-24 when he did destroy the property of the City of Monroe, two street light poles that were along the sidewalks.
Mr. Peavy was in violation of O.C.G.A. 40-6-390 Reckless Driving when he used disregard for the safety of persons or property when he was driving in excess of speeds of 60 to 70 miles per hour in a 25 mile per hour speed zone in the downtown area of the City of Monroe.
Mr. Peavy was in violation of O.C.G.A. 40-6-48 failure to Maintain Lane when he did fail to maintain lane of travel before the attempt to flee and elude and during the attempt to elude losing control of the vehicle going into the oncoming lane of travel and going off the roadway.
Mr. Peavy was in violation of O.C.G.A. 40-8-23 (d) No tag Light by operating a motor vehicle on the highways of this state without working tag lights. Warrants for all the violation will be obtained on Preston Peavy by ezwarrant and they will be executed and severed to him at the Walton County Jail.
