On July 18, 2026, I (Officer Hill #28) was patroling around 22:30 in the area of [3900 BLOCK] Cleveland Highway. When I saw a vehicle parked in the parking lot of O’Rielly. O’Rielly’s closed at 21:00. When I pulled into to check on the vehicle and saw the vehicle was over the curb and half way in the grass. I spoke to the driver (identified as Adalberto Montoya) from the passenger side and then approached the vehicle on the driver side.

Mr. Montoya stated he had not had anything to drink or taken any illegal substances. When asked for his driver license he handed me a regions bank card. I waited a few seconds and told Mr. Montoya that he handed me a bank card that I needed his driver’s license. Mr. Montoya stated he did not have his driver’s license and then proceeded to hand me his driver’s license. I called for a adittional unit to come out with me for field sobriety.

While waiting for the officer to get on scene another vehicle pulled up and the woman stated that the car Mr. Montoya was driving is her vehicle (she was identified as [REDACTED]). I explained the situation and told her to wait in the truck until the investigation was over. When the other officer arrived on scene I asked Mr. Montoya if he was okay with me running him through some test to which he agreed. We then walked in front of O’Rielly to a level spot in the parking lot.

Mr. Montoya stated that he did not have any medcial conditions that would prevent him from doing the tests. I checked Mr. Montoya’s right and left eyes for equal pupil size and equal tracking. Both the left and right eye appeared to be of equal size and both the left and right eye showed equal tracking. I also performed the vertical gaze nystagmus which both his right and left eyes showed nystagmus.

I then went into the first test of Horizontal Gaze Nystagmus (HGN). While doing this test Mr. Montoya was swaying slightly. Both his right and left eye showed a lack of smooth pursuit. Both his right and left eyes showed nystagmus at maximum deviation and both his right and left eyes showed nystagmus prior to 45 degrees.

The next test I had Mr. Montoya do was the 9 Step Walk and Turn. Mr Montoya asked if he could use the bathroom and was ttold no due to Orielly being closed. While giving Mr. Montoya instructions to get in the starting position he kept his arms up and started before being told to do so. Mr. Montoya had to be told numberous times to stand with his left foot planted and to put his right foot in front of his left touching heel to toe and to keep his arms down by his side numberous times as well.

When told to get in the position he stood thier then asked what is he doing and then said that I told him to get on his left leg then proceeded to bring his right leg behind him then put it back down. When Mr. Montoya finally got in the starting position I then demestrated what he was going to do. Mr. Montoya stated he understood the instructions.

Mr. Montoya then started the test after being told to star. Mr. Montoya stepped off the line on step number 3, 8, and 9 then did a improper turn and asked what the instructions was again. On the way back Mr. Montoya stepped off the line at steps 3, 4 almost fell on step 5 also off the line, then stopped on step 8. The other officer asked if he would do the test again with his boots off to which Mr. Montoya agreed and asked if we would mind showing him how to do it. Then Mr. Montoya rambled about his friend doing field sobriety.

The other officer then reinstructed Mr. Montoya what to do. While being explained on what to do Mr. Montoya was swaying side to side and did not stay in the starting position and had to be told numberous times to get back in the starting position. Mr. Montoya asked if he was walking to the crack in the pavement and kept saying he keeps going straight and was told to get back in the start position and was shown how to do the 9 step walk and turn test. Thnen gets out of the starting position asking how to do the turn at the end he was then shown how to do the test again.

Then Mr. Montoya asked about the starting position. I had to go change flashlights cause mine started malfunctioning. When I walked back I saw Mr. Montoya on step 5 use his arms for balance and step of the line and almost fell. He then did a improper turn and used his arms for balance on steps 1, 2, 3, 4 and stepped off the line and almost fell on steps 4, 5 and went to step 10.

The last test I did was the One Leg Stand. Mr. Montoya asked if he could pee on the side of O’Rielly and said that we could watch I told him no he could not do that. Mr. Montoya was then instructed on how to do the one leg test and while being told he started before being told. Mr. Montoya picked up his left foot and used his arms for balance then started counting by 10’s after he put his foot down.

The other officer done a test and Mr. Montoya could not figure out his left or right hand and kept confusing the instructions even after he acknowledged that he understood the instructions. When asked if he had any alcohol he stated no then changed the answer to not a lot then to just two.

Mr. Montoya then blew in a PBT and it showed positive for alcohol. Mr. Montoya was asked to cconfirm his age and he started rambling numbers then when asked his birthday he sarted talking about 2025, 2026 and did not know his birthday. I then asked if he was under the age of 21 and he said yes. I then read Georgia Implied Consent for suspects under the age of 21 (DDS-354 (05/2019)) to Mr. Montoya and he agreed to have his blood drawn. Mr. Montoya was then placed under arrest I checked the handcuffs for fit and double locked them and was placed in the back of my marked patrol vehicle.

Ms. [REDACTED] recovered her vehicle and was able to get it unstuck. I then transported Mr. Montoya to the Varnell Police Department to have his blood drawn. When we arrived at the Varnell Police Department I had to help Mr. Montoya up the steps so he did not fall. I let Mr. Montoya use the bathroom. Then had to help hold him steady and guide him to the room to have his blood drawn then Mr. Montoya was placed in handcuffs with them in fron of him and handcuffs was checked for fit and double locked. After the blood draw Mr. Montoya was confused on how to get back to the front door, I guided Mr. Montoya back to my patrol vehicle where he was placed in the back seat

Mr. Montoya then was transported to the Whitfield County Jail where he was handed over to the booking staff without incident.
