On this date and time I was located at the Circle K on Highway 71 and Highway 2 when I noticed a vehicle turning right onto Highway 2 stop on the roadway with traffic behind it. The vehicle stayed there for several seconds before proceeding westbound. I initiating a traffic stop on the vehicle, which was a white in color Kia K5 with Tennessee registration of [REDACTED], at Highway 201 and Sonya Dr. The vehicle slowed down and stopped on the roadway past Kids Dr.
I approached the vehicle from the passenger side and noticed two occupants inside at that time. I notified the driver, who was Adam Bates, for the reason of the stop. I asked why he stopped on the roadway next to the Circle K and he advised that he was attemping to fix the GPS on his phone. He handed his Tennessee driver’s license to me and I asked for his proof of insurance. He search in his passenger side glove compartment and advised that he did not have it on him at that time.
I asked what vehicle insurance company he used. He retrieved his phone and proceeded to scroll through his apps for a long moment. He then advised he used direct insurance. While speaking with him I noticed that his eyes were watery and could detect an odor of an alcoholic beverage coming from the vehicle.
I ran his drivers license and registration throught my vehicle’s terminal, finding valid with no wants.
I then requested for another officer to be enroute to my location.
I returned to the driver and asked for him to exit and to step to the rear of it. At that time I could detect that the odor of an alcoholic beverage was coming from his person.
I then began conducting Standardized Field Sobriety Test. I asked if he had any recent head injuries or medical issue. He advised that he did not and that he took medication for high blood pressure. I performed the medical examination part of the test and found both pupils equal size and tracking.
I could detect nystagmus during lack of smooth pursuit and distinct and sustained nystagmus at maximum deviation.
I instructed Mr. Bates to stand in the starting position for walk and turn and to stay in that position until instructed to begin the test. He advised that he understood. I then demonstrated the walk and turn test. He advised that he understood instructions. I observed that during instructions Mr. Bates was unable to maintain balance. I also observed him swaying and conduct an improper turn.
I then instructed Mr. Bates to stand in the starting position for one leg stand test and to remain that position until instructed to begin the test. He advised that he understood. I then demonstrated the one leg stand. I observed him sway several times during the test.
I conducted lack of convergence and found that his eyes did not cross.
During modified rhomberg I could detect eyelid tremmors.
I then demonstrated the finger to nose test to Mr. Bates and he advised that he understood. I observed him failed to correctly touch finger to nose 5 times.
I asked if he had taken any alcoholic beverages or medication this date and he advised that he did not. I spoke with the passenger who was [REDACTED]. And she advised that Mr. Bates had 1 alcoholic beverage while they were together. I then attempted to have Mr. Bates blow into a portable breath test. He attempted three times but refused to blow hard enough.
Mr. Bates was placed under arrest and a search of his person was performed. He was then placed on the rear passenger side seat of my patrol vehicle. I read implied consent and he refused to give blood.
I then requested to Whitfield County Dispatch to have the Varnell City listed wrecker service to be enroute.
While I transported Mr. Bates to the Whitfield County Jail, Sergeant Williams stood by and waited for the city listed wrecker service, who was Franks towing.
While at the jail Mr. Bates was served an administrative license suspension form and was signed by him.
Mr. Bates received a citation for DUI-Combo Any Combination of A1/A2/A3 (OCGA 406-6-391a4), Improper Stopping On Roadway (OCGA 40-6-123(C)) and Holding/Supporting Electronic Device (OCHA 40-6-241(c)).
