Failure To Obey Traffic Control Devices; Running Red Light
Officer’s Narrative:
On 05/29/2021 I Sergeant Corso was sitting stationary in a marked patrol vehicle on the west side of S Thornton Ave just south of W Walnut Ave facing north. I was observing the traffic light for traffic violations.
I observed a white passenger car approaching the traffic signal north bound on S Thornton Ave. It was traveling at a high rate of speed and the light was currently red in the north direction. The driver of the vehicle began to brake hard almost losing control and quickly turned right onto Walnut Ave. The traffic light was red and there is a traffic sign stating no turn on red.
I then began to attempt to catch up to the vehicle. It was still traveling quickly and appeared to have trouble maintaining its lane. I initiated a traffic stop and it took the driver time to realize I had activated my lights. It also took the driver several blocks to stop the vehicle. The vehicle came to final rest in the entrance of Shaw Industries main building on V D Parrott Pky.
I made contact with the driver and sole occupant. She was identified as Alicia Maria Gutierrez by GA drivers license. I could smell the odor of an alcoholic beverage emanating from the vehicle and her person. I could also smell the odor of freshly sprayed perfume. I observed a bottle of perfume laying in the passengers seat with the top off of it. The female’s eyes were glossy and dark in color.
I then called for another unit to respond to assist with field sobriety testing. Officer O’Neal responded and asked the driver to perform two sobriety tests. When the driver exited the vehicle she appeared to be slightly unsteady on her feet. The subject was placed into custody for DUI by O’Neal and he transported her to the county jail.
I inventoried the vehicle and transported her cell phone to the jail as to not leave it in the vehicle with the wrecker. The subject was charged with the traffic light violation and DUI.
