Officer’s Narrative:

On 07/21/2026, around 1730, Officer J. Ross & I were dispatched to [REDACTED BY AGENCY] in reference to a domestic disturbance in progress. Dispatch advised officers that a man by the name of Anibal De Jesus Magana Barrios was back on scene at the residence after he was previously served with an “Ex Parte” order earlier in the day.

While en route, dispatch confirmed that the male was in fact served with that paperwork around 1600 that same day. I was also advised that the Anibal suspect was in the progress of breaking into the house and using what was described as a sledgehammer to break the doorknob off the door to gain entry into he dwelling and access to the victims.

Upon my arrival, I quickly made my way to the residence. I asked dispatch if the suspect had successfully made entry into the residence. I was told no. Despite this, I could hear several loud banging noises over and over again coming from within the garage. It sounded as if metal objects were being slammed into each other with intentional force.

I quickly came to the realization that Anibal De Jesus Magana Barrios was already inside the residence and was just beyond the garage door. I squatted down, wrapped my hands around the bottom of the doorway and forced the garage door open. I drew my department issued pistol out of its holster as I entered and maintained a low ready position. “Low ready” means that both hands were on the sidearm, my trigger finger was indexed where the grip and slide meet & my arms were extended outward while I kept the pistol pointed towards the ground. This position allowed me maximum field of view while also being ready to respond to any possible threat.

As I walked around the left corner of the garage, I heard and saw that Anibal had just broken the doorknob off an interior door that would have allowed him access to the rest of the house and the 2 victims within. His back was to me and I couldn’t see his hands at that moment. I pointed my pistol around the bottom of his feet/legs and gave loud verbal commands for Anibal to drop what he had and show me his hands.

He quickly turned around and dropped the metal single-handed sledgehammer on the ground. He complied when I told him to put his hands behind his back. He was taken into my custody at that point after being handcuffed. On the ground I saw the hammer and file that he was using to force his way deeper into the house. The doorknob was no longer attached to the door and was laying on the ground in pieces. The sledgehammer and file both had red and black handles on them.

After a short time later, Officer J. Ross and C. Sosa arrived on scene to assist me. Anibal was handed over to Officer J. Ross. I informed Officer Ross to thoroughly make sure Anibal didn’t have any additional weapons on him and read him his miranda warning in front of my patrol vehicle before obtaining any of his statements.

I then made my way back to the residence to check on both [VICTIM #1] and her daughter, [VICTIM #2]. Both women were just beyond the door that Anibal was breaking through as I arrived. They had done their best to barricade the door using household objects to protect themselves and buy time. I identified myself as an officer of the Dalton Police Department and asked that they come out to speak to me. I could hear the terror & tremble in the voice of both women. They were both emotionally shaken by what had just happened. I spoke to [VICTIM #1] while officer C. Sosa spoke to her daughter.

I had [VICTIM #1] walk me through what had happened before I arrived on scene. She said that around an hour and thirty minutes after being served the Ex Parte order, Anibal arrived back at the house. Her daughter was the one to first notice that he had returned when she heard his truck drive by. Shortly after this, her daughter visually saw her father and the truck. She quickly alerted her mother to the fact that he was back on the property.

[VICTIM #1] quickly made her way to the front door and managed to lock the deadbolt with only seconds left to prevent the suspect from entering the home. She then called 911. He made his way into the garage and utilized a sledgehammer and file to break the doorknob off.

Both the mother and daughter would later express that they were in fear of what he would do to them once he broke through the door. I asked if he had made any threats to hurt them while he was using the hammer against the door. She said that it was difficult to hear what he was saying over the loud noise, but he was laughing and even telling her to call the police as if it were in an insulting nature. [VICTIM #1] told me that there is a long standing history of mental and physical abuse in the household at the hands of Anibal. [VICTIM #1] told me that the sledgehammer and file both belonged to Anibal and he retrieved them from his tool bench as he came into the garage.

The sledgehammer and file were seized as evidence and entered into P&E by Officer J. Ross. Ring doorbell footage was sent to Officer Sosa and myself by [VICTIM #2]. The footage captures her father coming to the home, attempting to come through the front door, him making his way into the garage, making forced entry, my arrival on scene, and a few minutes after he is taken into my custody.

This along with pictures of the damage caused by the suspect, tools, and the Ex Parte order will be attached to this report under the files tab. Officer Sosa transported the suspect to the W.C.S.O on my behalf. I later successfully applied for a warrant for the arrest of Anibal De Jesus Magana Barrios for the following charges on warrant # “W26-1218”.

I Personally served to the arrestee while he remained in the custody of the W.C.S.O & informed him that he would be required to make first appearance due to the nature of the charges. The following day, I spoke to representatives at the D.A’S office about the case before the arrestee made first appearance.

I requested that he be denied bond in order to protect the 2 victims in this case. This was done due to the fact that the offender has already shown to be very violent while showing complete disregard for the authority of an Ex Parte order being served. I have another further to report at this time.
