On 11.22.25 at approximately 1940 hours I, Ofc T. Hammontree, was dispatched to the Willowdale Staylodge, 1116 Willowdale Rd, in response to a male within the parking lot causing a disturbance and holding a knife. The male was described to be hispanic and wearing a grey shirt and brown shorts.
Upon arrival, I located a group of individuals in the rear of the complex who stated that a male in room #[REDACTED] had been outside prior to call time where he was yelling at other residents and attempting to initiate physical fights.
One individual I spoke with, [WITNESS #1], advised that he knows the male as “Tony” in room #[REDACTED], later identified as Antonio Frutoz, was outside in the parking lot while cursing in a loud and boisterous manner. He went on to say that he observed Frutoz holding a black fixed blade knife as he was yelling at others in the complex, however he stated Frutoz did not brandish the knife towards any particular person. [WITNESS #1] advised that he was concerned for other tenants’ safety due to Frutoz’s erratic behavior while holding a weapon. At the time of speaking with [WITNESS #1], Frutoz was inside room #[REDACTED]. As I approached towards where Frutoz was stated to be located, I noticed a considerable number of other tenants were outside.
Once near Frutoz’s room, he slowly opened the door where I was able to speak with him. I noticed that Frutoz was wearing the same clothing as was given by dispatch during the initial call. I also observed that his nose was swollen with blood on his face and clothing.
I began asking Frutoz if he was ok which he kept replying that he was heavily intoxicated and fell on his face. I asked Frutoz if he had a knife on his person which he stated he did not possess any weapons. I then detained Frutoz in handcuffs and patted him down for weapons which I did not locate any on his person.
Near this time, Ofc. Cook arrived to assist in gathering witness statements. 2 Tenants that he had spoken with, [WITNESS #2] and [WITNESS #3], were standing across the parking lot on the second level balcony. They advised him that they observed Frutoz in the parking lot yelling and cursing towards no person in particular, however then went up to the second story where he began kicking other tenants vacant chairs and banging on their doors in the attempt to start a physical fight. They advised Ofc. Cook that Frutoz then returned to his room moments prior to my arrival.
Based on my observations of Frutoz being heavily intoxicated and causing a disturbance in a public area while using profanity and a loud, boisterous voice I made the decision to place him under arrest. This decision was supplemented with multiple witnesses becoming concerned for their safety as well as others due to his erratic behavior.
I then escorted Frutoz to my vehicle where he was seat belted in the rear. Frutoz consented for me to enter his apartment to retrieve his phone. I then transported Frutoz to the Whitfield County Jail where he was turned over to the booking staff without incident.
I Contacted on-call magistrate Judge Martin where warrant# W25-1933 was issued for Frutoz for the offense:
OCGA 16-11-39 Disorderly Conduct
OCGA 16-11-41 Public Drunkenness
I Printed the original warrant and returned to the Whitfield County Jail where I served it to Frutoz. The warrant was then handed over to the booking staff.
During this incident the suspect was advised they were under arrest. The suspect was searched incident to arrest. My patrol vehicle was searched prior to and following transport of the suspect. The suspect was secured in a seatbelt during transport. While at the jail my department issued side arm was secured inside a locker. The suspect and their belongings were turned over to booking staff at the jail with no issues. Booking staff was made aware of any medical or security risks at the time of handing the suspect over. The suspect advised that they were an American citizen.
