Officer’s Narrative:

On 6/9/2026 at approximately 1033 hours, I, Officer Haven, was sitting stationary in the area of Ola Dr off of Highway 71. I observed the listed vehicle, a white 2014 Ford F150, pass me with a modified exhaust. The vehicle was loud enough for me to hear it with the windows up and music playing. I caught up to the vehicle and ran the vehicle through GCIc and it returned expired as of 4/19/2026.

I then positioned my vehicle behind his and the driver activated his turn signal to turn on the next road. I then conducted a traffic stop on the vehicle, stopping at Hwy 71 and Jamerson Way. When the vehicle came to a stop, the driver immediately put his hands out of the window.

I approached the driver side of the vehicle and began speaking with the driver, Mr Brandon Parris. I told him that the reason for the stop was that his tag had expired. He then stated that the registration and everything was currently at his mother’s residence in Tennessee and that he has not had time to go and get it. I told him that the vehicle also had a loud and noisy exhaust and I asked him if he had anything done to it. He stated that he had flowmasters installed from the headers all the way to the end.

While speaking with Mr. Parris, I noticed that he was talking really fast, to the point that it was hard to understand him and that he was slurring his speech. I also noticed that he had constricted pupils and rigid muscle tone. He was also going into long details when I was asking him simple questions.

I asked him for his driver’s license and he stated that he did not have it with him and that he was waiting for them in the mail and that he had the paper on him somewhere but did not know where. He stated that he went to the DMV last Monday to get his license renewed and that they should be here this week. He then stated that he knows it sounds like a bunch of bullcrap, but it is for real. I then asked him to step out of the vehicle.

When the driver stepped out of the vehicle, he put his hands in the air and walked back to the rear of his vehicle. He then turned away from me and began facing the truck bed. He then stated that he was keeping his hands where I could see them. I then walked to my vehicle. While I was retrieving something from my vehicle, Mr. Parris became fidgety. He began dropping and raising his arms and pacing back and forth. When I was getting in the car, he stated that all of his documents were at his mother’s house.

I then began walking back toward the driver. I asked him where he was heading to today and he stated that he was going right here, and pointed to Jamerson way, and stated “I was going to a buddy’s house to use his phone so that I can get a hold of my momma, who lives on something springs road (I could not understand what name he said for the road) so that I can get a hold of her. Yes sir.” He then began describing where his mother lived.

I then asked him for his name and date of birth. While giving me his name and date of birth, he began raising and dropping his hands and twisting his hands. He then began moving his hands and arms all over and stated that he had ADD and ADHD and did not know what to do.

I asked him if he license was suspended and he stated “no sir, no sir, no sir, no sir, no sir, no sir, I just, I don’t have them, that damn door pocket right there *points to driver side door*, the pocket, it falls out the bottom of the damn door!” I then replied with “Man”, he then stated “Dude, the passenger s-, I tell ya I was teaching a girl how to drive and she hit a blue dumpster right here” he then began showing me the damage to his vehicle that has no bearing on the case and was not asked about.

While he was telling me about the damage to his vehicle, I noticed that he was unsteady on his feet and almost fell. He continued to keep his hands up when he was not talking and stated that he was doing it because he was tackled one time and that he was an old man now. I then told him to hand tight and walked back to my patrol car.

I then ran Mr. Parris through GCIC and he returned valid through Georgia. I then walked back to speak with him. I asked him if he had taken anything today and he stated “no sir, I just got up, the church bought me a motel room for two days in Chatsworth and I just got up. No joke. [REDACTED], it’s that dude from Celebrate Recovery, just got me two rooms in a motel in Chatsworth and I just now got up and left the motel.”

I then began to tell him why I was asking and he cut me off and stated rapidly, seemed fidgety and then stated something that I could not understand. I then told him that he was talking a million miles an hour right now. He then stated “This is me stone cold sober boss, if you don’t believe me then get some brass on the phone, look here I got ADD, ADHD, OCD, Autism, and I am at the most extreme end of it. This is me stone cold sober baby, call anyone that you want to i mean yall. This is me sober sir. Hell, I’m going to tell you about 43 different things, I can do 63 things at once or nothing” Mr. Parris stated over half that first sentence in one breath and had to take a deep breath before he stated that he was at the end of it.

I then stated “uh-huh.” He then stated “I know you think blah blah blah but.” I then asked him if he was willing to do any tests to see if he was intoxicated. He started to become agitated and began looking around as if he was trying to find a path to escape. He then stated that he would. I then advised dispatch and requested a second unit. Mr. Parris then began yelling “this is why I can’t get a job, they keep asking are you on drugs, then they talk to me like I am stupid and make me go take a drug test. When it comes back, they are like wow, you’re really not on drugs. Hell you done p*ssed me off now!” We then began the tests. During the tests, Assistant Chief Swilley arrived on scene.

The first test was Horizontal Gaze Nystagmus. I had the driver get into the starting position. I then gave him the instructions and asked him if he understood them. He stated that he did. I then checked for equal pupil size and equal tracking. I did not observe any clues during this test. While conducting the test, I asked Mr. Parris how long he had been in recovery. He stated “not long. I’m trying ya know, but I promise you I am not under the influence of nothing sir” I then asked him what he was in recovery for and what his drug of choice was and he stated “Meth”, I then asked him when the last time he used was and he stated “about a week or so.” We then moved to the next test.

The next test was the Walk and Turn. I told him that I wanted him to imagine that there was a straight line going from where he was to the front of my car. He then asked if he was doing heel to toe. I then told him to just imagine a straight line right now and nothing else. I had Mr. Parris get into the starting position. He then began swaying and flailing his arms about and stated “come on man, look here dude, I can’t” I then told him that it was not a balance test, it was a can you follow instructions test. He then said, “alright dude, I’m listening.”

I then demonstrated the test and he stated “man, if I look at my feet I will fall on my face,” I then attempted to finish the instructional phase, and he moved from the starting position and then attempted to start the test before being told to do so. I then had him get back to the starting position and remain in the starting position. I asked him if he understood the test. He stated that he did. I then told him to begin when he was ready. While doing the test, Mr. Parris took an incorrect number of steps. He lifted his arms for balance, and he turned improperly. I totaled 5 out of 8 clues from this test. We then moved to the next test.

The next test was the One Leg Stand. I had the driver get into the starting position. I then gave him the instructions and asked him if he understood them. He stated that he did. I then told him that if he understood the instructions, then he may begin whenever he was ready. During this test, Mr. Parris immediately raised his left arm. He then put it back on his side and gripped the side of his shorts. He then began swaying and hopped, causing him to raise his left arm again and almost fall. I totaled 3 out of 4 clues on this test. We then moved to the next test. I told Mr. Parris that we had three tests left.

The next test was Lack of convergence. I had the driver get into the starting position. I then gave him the instructions and asked him if he understood them. He stated that he did. I then began the test. When I moved my finger toward the bridge of his nose, Mr Parris jumped his head back after a second delay. Mr. Parris did not show a lack of convergence. We then moved to the next test.

The next test was Modified Rhomberg. I had the driver get into the starting position. I then gave him the instructions and asked him if he understood them. He stated “sh*t, I won’t make it 30 seconds, that is a long time! Lean back like this, hell no one can stand back like that !” I then told him that I could. He then made a face and said “sh*t far.” I then gave the instructions again and he attempted the test before being told to do so.

I then told him to stop and gave him the instructions again. I asked him if he understood them and he stated that he did. I then told him to begin. He stopped the test at 39 seconds, which is outside the normal 25-35 seconds. He had major eye flutters and kept opening and closing his eyes. He was also swaying back and forth. I asked him how he counted and he stated that he estimated like I told him to. I then told him that we were going to the last test and he stated “that is what you said two tests ago!” and then pointed to AC Swilley. He then continued angrily, “see what I’m saying! See how he keeps telling sh*t! I’m sorry officer “Haven” I then went to the next test.

The next test was the Finger to Nose. I had the driver get into the starting position. I then gave him the instructions and demonstrated the test. He stated “come on man, you know I’m not going to be able” and then stated something that I could not understand. I asked him if he understood the test and he stated that he did. I specifically stated that he was not to use the pad of his finger during the test. We then began the test.

I gave the commands in this order, Left, Right, Left, Right, Right, Left. The driver did not touch finger to nose as instructed on all 6 attempts. Instead of touching the tip of his finger to the tip of his nose, he touched the pad of his finger to the tip of his nose. He was also told to close his eyes during the test because he started to open them during the test.

I then asked him if the last time he had taken anything was a week ago and he said “yes”. I asked him if he was on any prescription medications and he stated “No.” I then told him that he showed signs of impairment and that he was under arrest for suspicion of DUI. I handcuffed him behind the back, checked for proper fit and double locked them. While handcuffing Mr Parris, he stated that he swore he was not on anything and to give him a test. When I started the first test, I could smell the odor of alcohol coming from Mr. Parris. Due to the results of the field tests, I did not believe that Mr. Parris was impaired on alcohol alone.

I then searched him for weapons and contraband, none were found. I then searched the rear of my patrol car for weapons and contraband, none were found. I then placed him into the back of my patrol car. I was getting ready to read him the Georgia Implied Consent notice for suspects over the age of 21, when Mr. Parris stated that if I gave him a piss test, he would fail for marijuana because it takes a month to get out of his system and he has only been clean for a week.

I then read him the Georgia Implied Consent notice for suspects over the age of 21 and requested a blood test. Mr. Parris would not answer and just kept repeating that he would fail for marijuana. Due to him refusing to answer, it was taken as a refusal. The next list wrecker for the vehicle, Bob’s Towing, was called to come and get the vehicle.

I then conducted an inventory of the vehicle. I located a metal smoking pipe in the driver door of the vehicle that smelled strongly of the odor of marijuana. I also located a half empty 375ml bottle of Jim Beam in the passenger floorboard. I also located a container sealed and wrapped in duct tape under the rear bench seat that was empty and had residue for marijuana. I also located Mr. Parris’s wallet that had the title to the vehicle in it, even though Mr. Parris stated that he did not have a wallet or phone in the vehicle.

Bob’s Towing came and the vehicle was released to Bob’s Towing. The tow driver began hooking up the vehicle, when Mr. [REDACTED] arrived on scene and requested that the vehicle be turned over to him. AC Swilley spoke with Mr. Parris and Mr. Parris stated that they could get his vehicle from the wrecker. He then paid Bob’s Towing and they released the vehicle to Mr. [REDACTED].

Mr. Parris was then transported to the Whitfield County Jail. He was turned over to jail staff without incident. The jail staff administered a PBT and it did show positive for alcohol. I then searched the rear of my patrol car for weapons and contraband, none were found. I then went back into the jail to turn over paperwork and serve Mr. Parris with a DD-1205 Automatic License Suspension for DUI refusal.

Jail staff advised that they had to put him in a cell because he began agitated with the jail staff. He also requested to speak with a detective that worked at the sheriff’s office, but would not tell them why. They stated that the detective that was named was not employed by the Whitfield County Sheriff’s Office and that they have no idea who he is.

Mr. Parris was charged with DUI less safe multiple substances (Cit#140000231), Open Container of Alcohol in Motor Vehicle (Cit#140000232), Possession and use of Drug Related Objects (Cit#140000233), Improper Exhaust (Cit#140000234), Expired Registration (Cit#140000235), and No License on Person (Cit#140000236). All evidence recovered was logged and placed into evidence locker 10. The empty containter of residue was left in the rear of the vehicle.

After the arrest, I reviewed the back seat camera of Mr. Parris from the time he was placed in the back of my car until he arrived at the jail. Mr. Parris began speaking to himself and started to get more agitated. He also continued to lick his lips as if he had dry mouth. The conversation appeared to be him talking to me as I took evidence out of the vehicle and conducted the inventory of the vehicle. At one point, he began answering himself. Saying “yeah” and “no.” He continued to carry a conversation with someone in the back of the patrol car that was not there.
