On 14 April, 2025 at approximately 09:00 hours, I was dispatched to Sun Tan City located at 1329 W. Walnut Ave. in reference to a lewd act.

While enroute, dispatch advised a homeless male wearing white shoes and a white blanket had urinated in front of the business. Upon arrival, I made contact with the complainant, [REDACTED], who advised a customer, [WITNESS #1], came in and told her that she just witnessed a male urinating outside the business.

Contact was made with the male, Damon True, who was seated on a bench in front of Las Palmas, approximately 10 feet from a fresh wet spot that started near a pillar and trailed into the parking lot. Damon stated he was the one who urinated in the area. Based on eye witness accounts, Damon stating he urinated in a public place and in view of the public, I advised him he was under arrest. I placed Damon in handcuffs (double locked and checked for proper spacing). Search incident to arrest, no contraband was located on his person. Damon advised he is a US citizen.

Prior to placing Damon in the rear of my patrol car, the back seat was checked with no contraband being located. Damon was placed in the rear of my patrol car where he was safety belted in. I then made contact with [WITNESS #1] (witness) who advised she was sitting in her vehicle waiting for her appointment in Sun Tan City. [WITNESS #1] stated she observed Damon seated on the bench in front of Las Palmas, get up, walked into the roadway, face a brick pillar, and begin urinating. [WITNESS #1] advised she took her phone out and videoed the incident. [WITNESS #1] stated once the male was done, he sat back down on the bench.

I reviewed the video and in it, Damon is seen facing a brick pillar with a stream flowing from his pelvic region and onto the ground in the area I observed the fresh wet spot.

I transported Damon to the Whitfield County Jail where upon arrival, I secured my service pistol in the lock boxes provided. Damon and his property were turned over to the booking staff without incident. While there, I completed a warrantless arrest form #70155 charging Damon with violation of O.C.G.A. 16-6-8 Public indecency. A copy of the warrantless arrest was provided to the booking staff.

Prior to leaving the jail, I searched my back seat with no contraband being located and retrieved my service pistol.

At this time, this case is closed due to Damon’s arrest
