[NARRATIVE #1 on January 26, 2026]

On 1/26/2026 at approximately 1445 hours units were dispatched to [100 BLOCK] Tilton Court in reference to a domestic dispute in progress. Dispatch advised that [REDACTED] had called in saying a [REDACTED] and [REDACTED] were making threats to her sister [VICTIM #1]. She stated they threatened to “beat her a*s” and didn’t care if law enforcement was called. [REDACTED] then advised that her [VICTIM #1] was leaving and that the two males were following her driving a white truck.

Sgt. Southern then began responding to the scene from the area of Carbondale Road and I-75. The truck was not observed driving on Tilton Road. Sgt. Southern and Deputy Scott arrived at the house and began knocking on the door and windows trying to make contact with someone. At this time, a white Ford F-150 pulled into the driveway along with a black Camaro, and two Hispanic males exited the truck. Sgt. Southern and Deputy Scott walked down to where the truck was parked and Sgt. Southern told the driver to come back to where he was since he was walking away back toward the house. The male stopped but refused to come back to where Sgt. Southern was standing. The male was given multiple verbal commands to come back and he responded by standing where he was and saying “I am not coming back to you” and “no”.

After saying “no”, the male then turned from Sgt. Southern and began walking away. Deputy Scott then grabbed him by the jacket and pushed him back into the side of a pull behind camper. Sgt. Southern grabbed the male by the left arm and jacket. As both Deputies continued telling the male to come back, the male was pulling away, still not complying with commands, and again said “no”. Sgt. Southern then observed him reach with his right hand to his right rear waistband area. The motion appeared as if the male was reaching for a gun. Sgt. Southern then alerted Deputy Scott that the male was reaching for something and grabbed the male’s arm in an attempt to prevent him from getting the item.

Deputy Scott then fired his Taser multiple times striking the male. He locked up and fell onto a pile of metal roofing. Deputy Scott then yelled that the male had a gun. Sgt. Southern drew his handgun and gave the male verbal commands to stick his hands out. While the Taser cycle was running Sgt. Southern located the handgun beside the male and was able to toss it away from him. When the Taser cycle ended, the male stuck his hands out and Sgt. Southern was able to place him under arrest. During this interaction and while speaking with the male, Sgt. Southern smelled the odor of an alcoholic beverage. He was identified as Erick De Jesus Martinez-Perez.

Erick was placed in Sgt. Southern’s patrol vehicle after being searched. Several hundred dollars, some .223 rounds, his wallet, sunglasses, and a pocket knife were all turned over to his wife. EMS was requested to the scene to check on Erick. A search of the truck was conducted and an open container of a Coors Light screw top can was located behind the passenger seat. The same type cans were later located in the yard around a fire pit. Sgt. Southern observed the windshield to be busted on the passenger side and the front bumper to have a large dent with a chuck of wood sticking in it on the drive side.

While speaking with [WITNESS #1] about the incident he stated that his aunt [VICTIM #1], was in an argument with others at the house. [VICTIM #1] then left the house and [REDACTED] and Erick drove behind her to a storage building they have to lock it up so that [VICTIM #1] couldn’t take anything that wasn’t hers. The storage building is located at [4300 BLOCK] East Nance Springs Road. [WITNESS #1] stated that his uncle struck a stump which caused him to hit his head on the windshield and shatter it. There was a noticeable mark on [WITNESS #1]’s head. [WITNESS #1] also stated that [VICTIM #1] had caused the argument, had opened his mail, and threatened to kill his mom. He became angry when [VICTIM #1] threatened his mom.

[WITNESS #2] ([WITNESS #1]’s mother) stated that there was a verbal argument between [VICTIM #1] and her husband [REDACTED] (different than the other [WITNESS #1]). [VICTIM #1] was the one causing the issue and she was saying “fu*k you” to [REDACTED]. [VICTIM #1] then turned toward [WITNESS #2] and said the same to her and threatened to kill her. [WITNESS #2]’s statements were translated by Deputy Ruedes via phone call with Deputy Scott.

[VICTIM #1] and [REDACTED] then arrived on scene wanting to pickup their belongings. [VICTIM #1] stated that she was at home when Erick, [REDACTED], and [REDACTED] arrived on scene. She stated that they all began arguing with her and blaming her for a window that was broken last night while they were drinking. She stated they had broken it and that they had been drinking since last night. She was then allowed to retrieve her Tahoe and items from the residence.

Deputy Center responded to [4300 BLOCK] East Nance Springs Road and observed where Erick had struck an oak stump. Erick had run wide on the driveway and hit the stump. There was no further damage and the property was owned by Erick’s family. They did not wish for charges.

As EMS was checking Erick, and Sgt. Southern spoke with him, he could smell the odor of an alcoholic beverage again coming from Erick as he spoke. Sgt. Southern transported Erick to the Whitfield County Jail. He was turned over to intake personnel without incident. Sgt. Southern applied for and was granted eFile Warrant 2026-111WA by Judge Martin. Erick was then served with warrant W26-165 Case 2026-947474 for the following charges:

Pictures of the damaged truck, Erick’s Taser probe locations, and the oak stump will be submitted to evidence.com. The handgun was a SCCY 9mm, and it along with one magazine will be submitted to evidence.

[NARRATIVE #2 on January 26, 2026]

On January 26th around 1500 hours, Deputy Scott and Sgt Southern arrived at [100 BLOCK] Tilton Court in reference to a disturbance.

While Deputies were attempting to make contact with someone at the residence, a white F150 and a grey Camaro pulled into the driveway. Deputies were previously told by dispatch that a white truck was involved in the disturbance. Deputies then went and contacted the occupants of both vehicles. Sgt Southern attempted to get the occupants of the truck to come talk to him but they continued walking away from him. Deputy Scott cut the males off and instructed them to return to Sgt. Southern.

One male, Erick Martinez-Perez, kept ignoring instructions. Deputy Scott then drew his department Taser 10 and held it at a low ready position. Erick kept refusing Sgt. Southern’s commands to return to where the truck was. Deputy Scott then armed the Taser 10 and commanded Erick to go to Sgt. Southern. Erick stated “no” and began walking toward Deputy Scott. Deputy Scott then grabbed Erick and drove him backward into a camper that was behind him and towards Sgt. Southern.

At this point, Sgt. Southern also went hands on with Erick. Due to the location where this was occurring, Deputies tried relocating to a more open area with Erick. Erick began trying to pull away and began reaching for something around the small of his back. Deputy Scott knew this to be an area where people often carry firearms on their person. Deputy Scott still had his Taser in his right hand and released Erick from his left hand. Sgt. Southern was attempting to control Erick and was unable to see Eric’s hands.

Deputy Scott observed Erick’s right hand leave from the small of his back and move towards the front of his body. Deputy Scott then observed a bright green pistol in Eric’s right hand. Deputy Scott then began discharging his Taser 10 towards Erick. Deputy Scott initially fired 8 Taser 10 cartridges at Erick in an attempt to achieve neuromuscular incapacitation. 7 cartridges impacted Erick in locations across his body ranging from his head down to his legs. At the time, Deputy Scott was in fear for his and Sgt Southern’s safety due to Erick having a firearm in his hand so Deputy Scott was not concerned with the cartridge placement but rather being able to subdue Erick.

Deputy Scott was able to achieve neuromuscular incapacitation causing Erick to fall on the ground. Deputy Scott then drew his department issued Glock 17 and verbally announced to Sgt Southern that Erick had a firearm. The way that Deputy Scott was standing, he could not see where the firearm was currently at. After the 5 second cycle had ended from the Taser 10, Erick’s hands began moving and due to not being able to see the firearm the he had brandished, Deputy Scott fired an additional Taser 10 cartridge at Erick’s leg. This again achieved Neuromuscular incapacitation and Sgt Southern was able to remove the firearm from Erick’s vicinity. Sgt Southern was then able to restrain Erick with handcuffs.
