Officer’s Narrative:

On 05/13/2026 at approximately 2055 hours, I was patrolling around Fields Ave and E Morris St.

I was behind a white 2006 Toyota Sienna, stopped at the red light at the intersection, heading northbound. When the light turned green, the vehicle proceeded through the intersection and nearly collided with a vehicle in the southbound lanes. I then followed the vehicle and observed it weaving into the center turn lane and remaining halfway in it for approximately 100 yards. The vehicle then turned on its blinker to turn right onto Nelson St. I then turned my emergency lights on and initiated a traffic stop. The vehicle then came to a stop on Nelson St.

I Then approached the vehicle and contacted the driver, Eulalio Roberto Ramirez Jeronimo. When I approached the vehicle, I smelled a strong odor of beer emitting from Roberto. I also noticed that Roberto’s eyes were red and glossy, and I could see a Coors light can in the cup holder next to the driver. I then asked Roberto to step out of the vehicle, and he complied.

I then requested an additional unit due to Roberto not speaking English. I then stood outside the vehicle with Roberto until Ofc Aldava #655 arrived on scene. Ofc Aldava arrived, and she began to explain to Roberto why I pulled him over. Ofc Aldava asked Roberto how much he had to drink, and he stated that he had three beers. Ofc Aldava then asked Roberto if he would be willing to perform a set of tests to determine if okay to drive, and Roberto agreed.

The first test I performed was the Horizontal Gaze Nystagmus (HGN). During this test I observed the following clues:

• Lack of smooth pursuit in the left and right eyes
• Distinct and sustained nystagmus at maximum deviation in the left and right eyes
• Onset of nystagmus prior to 45 degrees in left and right eyes.

For a total of 6/6 validated clues.

It should be noted that during this test, Roberto was told repeatedly to keep his head still and would get distracted and look away from my finger at times.

The next test I had Roberto perform was the 9-step walk and turn. Ofc Aldava explained and demonstrated the test for Roberto, and he stated they understood. During this test, I observed the following clues:

• Unable to maintain balance during instructions
• Starts too soon
• Misses heel to toe
• Steps off line
• Raises arms for balance
• Improper turn

For a total of 6/8 validated clues.

The last test I had Roberto perform was the one leg stand. Ofc Aldava explained and demonstrated the test to Roberto and they stated they understood. During this test I observed the following clues:

• Puts foot down
• Uses arms for balance
• Sways while balancing
• Hopping

For a total of 4/4 validated clues.

The last test I had Roberto perform was the alco-sensor. The alco-sensor is a device approved by the GBI forensics division. During this test, Roberto tested positive for alcohol with a breath alcohol content of 0.292 brac.

I then placed Roberto under arrest for DUI, driving without a license, open container, and failure to maintain lane. I then placed Roberto in handcuffs behind his back, double locked, and checked for proper fitment. I then searched Roberto incident to arrest, and I did not locate any contraband. I then searched the backseat of my patrol vehicle prior to placing Roberto in the back seat, seat-beltting him in.

I then conducted an incident-to-arrest search on Roberto’s vehicle. I located a can of Coor’s light that was half full and cool to the touch. I then retrieved Roberto’s phone from the vehicle because he wished to bring it to jail with him. I did not locate anything else in the vehicle. I then took the Coor’s light and poured it out in front of my patrol vehicle’s dash cam. I then set the empty can back into the offender’s vehicle.

While speaking with Roberto, a passerby, [REDACTED] asked me if they could take his vehicle and park it for him so it would not get towed. Ofc Aldava then translated this to Roberto, and he agreed to [REDACTED] moving his vehicle. [REDACTED] moved his vehicle and returned moments later with the keys to the vehicle. I then read the implied consent to Roberto in English, and Ofc Aldava explained it to him in Spanish. Roberto then agreed to give a sample of his breath.

I then transported Roberto to the Whitfield County Jail without incident. Upon arrival at the jail, I secured my department-issued firearm in the lockbox in the sally port of the jail. I then took Roberto out of my vehicle and searched the backseat, not finding any contraband. I then brought Roberto inside the jail. Ofc Aldava then performed the intoxilyzer 9000 test on Roberto. Roberto gave a breath sample of .245 bac. I then turned Roberto over to the Whitfield County booking staff and returned to my patrol vehicle to prepare the charges for Roberto.

I charged Roberto with
40-6-8, Failure to maintain lane, on citation #667779
40-5-20, Driving while unlicensed, on citation # 667780
40-6-253, Open container, on citation #667781
40-6-391a5, DUI alcohol .08 or more, on citation #667782

I then prepared an ALS form for Roberto. I then went back inside the jail and served Roberto with the citations and the ALS form. I then returned to the sally port and retrieved my department-issued firearm from the lockbox. I then left the jail and returned to the Dalton Police Department to submit the ALS form for Roberto.

It was later discovered that Roberto’s full name is Eulalio Roberto Ramos-Jeronimo. The jail staff notified me that they discovered his full name and that he had an active bench warrant. I then searched Roberto’s full name and found that he had a warrant through the Dalton Police Department.

I then relocated to the Dalton Police Department and located the warrant for Roberto (DMC593522). I then signed out the warrant and brought it to the Whitfield County Jail. Upon arrival, I resecured my department-issued firearm in the lockbox of the jail. I then served the warrant on Roberto and signed the warrant. I then left the jail, retrieving my department-issued firearm prior to leaving.

I then returned to the Dalton Police Department and took Roberto’s warrant (DMC593522) out of GCIC.
