On July 19th at approximately 2156 hours, I was dispatched to [500 BLOCK] N Spencer St in reference to a motor vehicle accident. Dispatch stated that it was a single vehicle crash between a black Mustang and a utility pole. Dispatch stated that the caller was anonymous but stated that she believed that the driver was impaired.

Once I arrived on scene, I observed a black Ford Mustang [REDACTED BY AGENCY] had swerved off the roadway and struck a utility pole belonging to Dalton Utilities, a mailbox post located at [500 BLOCK] N Spencer St along with a fence belonging to A-1 Towing and recovery (527 N Elm St). After observing the damage of multiple objects off of the roadway I was able to determine that the driver was unable to maintain his lane, and stay onto the roadway.

I then made contact with the driver who was the only occupant of the vehicle. The driver was identified as Freddy Fraire. I then had Freddy step out of the vehicle and relocate nearby my patrol car. At this time I observed that Freddy had begun to stumble and was struggling to keep his balance. I asked Freddy if he was okay or if he had any injuries. Freddy stated that he was okay. While speaking with Freddy I observed an odor of an alcohol coming off of his person.

When I asked Freddy what had happened, and Freddy stated that he was celebrating the Spain game. When I asked Freddy if anything happened while driving he stated once more “I was just celebrating the Spain game.”. I then asked Freddy how much he had to drink, and he replied saying “a few beers”. Sgt. Bowen arrived on scene at this time.

I then asked Freddy if he would perform a set of Field Sobriety Test’s, and Freddy agreed. I then performed Horizontal Gaze Nystagmus. I gave Freddy directions to follow the tip of my finger with his eyes and eyes only. As I began the test, Freddy continued to follow the tip of my finger by moving his head instead of his eyes only. Freddy was able to comprehend my instructions, and I began the test once more.

While performing the test I observed 6 out of 6 clues. I observed the following clues; lack of smooth pursuit in both left and right eyes, nystagmus at maximum deviation I both left and right eyes, onset of nystagmus before 45 degrees in both left and right eyes.

I then began giving Freddy instructions for the Walk and Turn Test. I instructed Freddy to place his foot on a straight line, then place his right foot in front of his left foot heel to toe. Freddy the took a series of steps but was unable to place his right foot in front of his left. Freddy then attempted to place his right foot in front of his left, and began stumbling and taking a series of steps in a circular motion. Freddy continued to stumble in a circular motion. Freddy began stumbling toward where I was standing, and I grabbed onto Freddy to make sure he did not fall. At this time I was able to determine that Freddy was under the influence and was too inebriated to complete the remainder of the Field Sobriety Tests.

I then placed Freddy into handcuffs, and escorted him to the front of my patrol car. Freddy was then searched incident to arrest. I confirmed that Freddy was a US citizen and that he had no concerning medical conditions. Freddy was then secured in the back seat of my patrol vehicle. I then read Freddy Georgia Implied Consent for persons over the age of 21. He agreed to give a sample of his breath.

I transported Freddy to the Whitfield County Sheriff’s Office. Once I arrived, I secured my firearm in the sally port. Freddy and his belongings were turned over to jail staff. Ofc. Greer administered the breath test, which resulted in 0.230 BAC (blood alcohol content). Freddy was charged with the following citations;

Citation #661654 OCGA 40-6-391(A)(5)- DUI/Alco 0.08 gm or more; 21 or over
Citation #661655 OCGA 40-6-48- Failure to maintain lane

Pictures of the accident will be attached. The vehicle was towed by Frank’s Towing, and a tow inventory sheet was completed. For more information regarding the crash refer to gears report 26-003864. An ALS form was completed and sent to the department of drivers services.
