On October 21, 2025, at approximately 2010 hours, Deputy Beach and Deputy Broling were dispatched to [200 BLOCK] Chappell Way, Dalton, Ga, 30721, due to a male, Gary Morrow, standing outside doing lewd acts.
Upon arrival Deputy Beach spoke with [WITNESS #1] and [VICTIM #1]. [WITNESS #1] advised that Gary was sitting in his bedroom in front of his window naked and mast*rbating. [VICTIM #1] advised that she noticed Gary mast*rbating while she was in the kitchen and closed the curtain. [VICTIM #1] advised that she went to get her phone to record Gary, so that she could show the police, but Gary had turned off the light and shut his curtain before she could take the video.
Deputies then went next door to ask Gary about the incident. Gary advised that he got out of the shower and sat in front of his window naked and began mast*rbating. Gary advised that his medicine causes him to do these acts. Gary advised that the medicine was Naproxen.
Deputy Broling contacted Deputy Cleary to get advice on how to handle Gary’s situation due to him being a sex offender. Deputy Broling found that in Hester v. State, Gary could be charged with public indecency, due to public place being defined as any place where the conduct involved may reasonably be expected to be viewed by people other than members of the actor’s family or household.
Deputy Beach arrested Gary for OCGA 16-6-8(A) Public Indecency due to both parties’ stories matching. Deputy Beach and Deputy Broling transported Gary to the Whitfield County Detention Center. Gary was then turned over to the Whitfield County Booking staff without incident. Gary was charged on warrantless arrest #70919.
