On 6/13/2026 at approximately 2251 hours, I, Officer Haven, was patrolling the area of Highway 201 near Highway 2, when I observed the listed vehicle, a silver 2016 Chevrolet Malibu, fail to maintain lane by driving past the white line onto the right shoulder.

The vehicle then went back into its lane and then crossed the double yellow line. The vehicle then weaved back into its lane and then continued to weave in its lane. I then activated my emergency lights and conducted a traffic stop. When the vehicle noticed me and began to come to a stop, the vehicle swerved and stopped in the middle of the road in both the north and south bound lane. The vehicle then moved over to the right shoulder.

I approached the vehicle and began speaking with the driver, Mr. George Arroyo. I could smell a strong odor of marijuana coming from the vehicle. I told the driver that the reason for the stop was that he was driving all over the roadway. He stated that he was hurrying to his residence because he had to use the bathroom. I asked him where he lived and he had trouble remembering. He had glossy eyes and constricted pupils. He was profusely sweating and had a second shirt draped over his shoulder. He stated that he lived in Chattsworth.

I then asked him if he was trying to get to Chattsworth and he stated that there was a store down the road that he was going to use the bathroom at. I asked him when the last time he smoked weed was and he stated that he smoked this morning. I asked him around what time it was and he paused for a few seconds and then stated “about 6”. I asked if he meant six in the morning and he said “yeah”. I then shined my flashlight to the parking lot of Dollar General, 1075 Tunnel HIll Varnell Rd, and told him to pull into the parking lot. I followed in my patrol car.

I then approached the vehicle and asked the driver if he owned the vehicle. He stated no and that a [REDACTED] subject owned the vehicle. He stated that she was selling him the vehicle. I then asked him to step out. When he exited the vehicle, he was swaying and put his extra shirt on the back of the vehicle. I asked him if he had any alcohol today and he stated that he did not. I then asked him if he only had the little bit of marijuana and he said “yeah.”

I asked him how much he smoked and he stated that he did not know. He then stated that it was just a joint. I asked him if he was aware that marijuana was an intoxicating substance and he stated that he did. I asked him if he knew that marijuana could impair you for up to 24 hours, even if he no longer felt the high and he stated that he did not. I then asked him if he would like to do some field tests to see if he was safe to drive and he stated that he did.

While speaking with him, I noticed that he was using the vehicle to keep his balance and he was swaying. He also had slow, slurred speech. He stated before the test that he was stabbed multiple times in the past and that his equilibrium was off. We then began the tests.

The first test was Horizontal Gaze Nystagmus. I had the driver get into the starting position. I then asked him if he wore contacts or glasses and he stated that he did not. I then checked him for equal tracking and equal pupil size. I asked him if he had any recent head injuries and he showed me a scar on his head. I asked when that occurred and he said about two years ago. I then began the test.

During the test, Mr. Arroyo moved his head multiple times and could not keep it still. I observed a lack of smooth pursuit and a distinct and sustained nystagmus at maximum deviation in both left and right eye. We then moved to the next test. The next test was the Walk and Turn. I had the driver get into the starting position. The driver could not stand in the starting position. He then refused the test and stated that he could not do it due to his prior injury. We then moved to the next test.

The next test was the One Leg Stand. I had the driver get into the starting position. I then gave him the instructions and asked him if he understood. He stated that he did. I then told him to begin. He lifted his foot approximately 1 inch off the ground and he was swaying and put his foot down multiple times. He then stopped and stated that he was not going to be able to do this test either. We then moved to the next test.

The next test was Lack of Convergence. I had the driver get into the starting position. I then demonstrated the test and gave the instructions. I asked him if he understood all of the instructions and he stated that he did. I then began the test. I did not observe a lack of convergence. We then moved to the next test.

The next test was Modified Rhomberg. I had the driver get into the starting position. I then gave him the instructions and asked him if he understood. He stated that he did. I then told him to begin. The driver stopped the test at 23 seconds. Which is outside the normal parameters of 25-35 seconds. We then moved to the next test.

The next test was finger to nose. I had the driver get into the starting position. I then gave him the instructions and asked him if he understood. He stated that he did. I then told him to begin. I then gave him the commands as follows: Left, Right, Left, Right, Right, Left. Mr. Arroyo did not touch finger to nose on all six passes.

After concluding the test, I asked Mr. Arroyo if he was sure that the only thing he had used today was marijuana and he stated that he was sure. I then told him that due to the results of the test, I needed him to place his hands behind his back. He then stated, “aren’t we supposed to go to a drug test, oh a breathalyzer or something next?” I then told him that we will get to that in a minute. He then turned around and placed his hands behind his back. I then placed him in custody for Driving under the influence.

I then searched him for weapons and contraband, none were found. I then searched the rear of my patrol car for weapons and contraband, none were found. I then placed him in the back of my patrol car. I then read him the Georgia Implied Consent Notice and requested a blood test. Mr. Arroyo agreed.

I then conducted an inventory of the vehicle and I located 2 individually wrapped nuggets of marijuana in a cigar wrapped in the center console of the vehicle. I also located a gold Lemonade brand THC vape pen in the center console. Using Google AI, the type of vapor pen contains a high content of THC and is not legal in Georgia for recreational use. I also noticed a 12 pack of Bud Light bottles in the passenger seat that was halfway empty with 6 full cold bottles of beer that still had condensation on it. It also had a gatorade bottle inside the box.

I also located a NARCAN nose applicator in the glove compartment, which is used for opioid overdoses. There was also a wrapped to go plate in the front passenger seat, indicating that the driver was heading home after a party. Given the clues that were observed and the items located in the vehicle, I believe Mr. Arroyo is impaired on multiple substances.

Officer Ellis was left with the vehicle. Bob’s Towing was dispatched to recover the vehicle. I then began transporting Mr. Arroyo to the Varnell Police Department for the blood draw. When I got in my vehicle, I could smell a strong stench coming from the rear of my patrol car. Mr. Arroyo then stated that he was not going to do the blood draw.

I then told him that was fine and then transported him to the Whitfield County jail. He was turned over to jail staff without incident. When I had Mr. Arroyo exit my vehicle, He stated that he defecated in the back seat because he told us that he had to use the bathroom and the other officer on scene told him that it was okay because we had trustees that can clean it. While at the jail, I served Mr. Arroyo with a DD-1205 ALS form. He was served without incident.

Mr. Arroyo was charged with DUI Less Safe multiple substances (Citation Number-140000244), Failure to Maintain Lane (Citation Number-140000246), and Possession of Marijuana less than an OZ (Citation Number-140000245). Copies of the tow sheet, ALS form, and citations were added to the case file. Pictures of all evidence were added to the case file. They were placed into evidence locker 5. Evidence collected was- 2 individually wrapped nuggets of Marijuana (Item 2) and 1 Lemonade brand THC Vape pen (Item 1)
