I was requested by Sergeant J. Mathis to be enroute to Cohutta Varnell Road next to Vic Miron for a possible intoxicated driver he had conducted a traffic stop on this date and time
I arrived and noticed Sergeant J. Mathis was speaking to a white male behind the stopped vehicle. Sergeant J. Mathis advised that the male was highly intoxicated and had a warrant through Dalton Police Department. I approached the male, who was James Burnett, and he advised that he was refusing any testing to determine if he was under the influence at that time. While he was speaking I could detect an odor of an alcoholic beverage coming from his person. I asked if he had smoked any marijuanna and he advised that he did the night prior. I placed him under arrest and did a search of his person. I then placed him on my marked patrol vehicle’s driver side rear seat.
I then transported Mr. Burnett to the Whitfield County Jail while Sergeant J. Mathis waited for the city list to retrieve the vehicle. On the way to Whitfield County Jail Mr. Burnett advised that I was a nazis that should commit suicide and used abusive lanuage majority of the way there.
When we arrived to the jail and entered the sally port I had Mr. Burnett exit the vehicle. When I grabbed his left arm to excort him inside of the jail he pulled away. I regrabbed the same arm and he began to get aggressive and irate. I escorted him inside and placed him at the designated intake area. After the jail received Mr. Burnett I went to central to retrieve his driving and criminal history. When I returned to booking a detention officer advised that Mr. Burnett was placed in a patted cell.
Mr. Burnett received a citation for Too Fast For Condition (OCGA 40-6-180), Failure To Maintain Lane (OCGA 40-6-48) and DUI-Combo Any Combination Of A1/A2/A3 (OCGA 40-6-391a4). An administrative license suspension was advised to Mr. Burnett and he refused to sign.
