On 12/28/24 I was dispatched to 1212 Broadrick Dr in reference to a possible sexual assault in room 207-A.

Upon my arrival, I spoke with the caller, later identified as [WITNESS #1], who advised me that she was a nurse aide along with her co-worker, later identified as [WITNESS #2]. [WITNESS #1] stated that her and [WITNESS #2] had went into room 207 to make contact with one of the patients, later identified as [VICTIM #1], to assist her in getting ready for bed time. [WITNESS #1] stated that when they entered the room, they noticed a male, later identified as James Jones, in the bed with [VICTIM #1]. James was described as “Spooning” with [VICTIM #1] and lying behind her with her back to his front. [WITNESS #1] stated that [WITNESS #2] then knocked on the bed frame and told [VICTIM #1] that they had to get her ready for bed. [WITNESS #1] stated that James then stated “I don’t give a damn what you want to do with [VICTIM #1].” when they asked [VICTIM #1] again, [WITNESS #1] stated that James appeared to realize that they were employees and quickly began to get up, but once he got up, he went to the corner of the room and fixed his zipper on the front of his pants, which was undone. [WITNESS #1] stated that her and [WITNESS #2] then noticed that [VICTIM #1]’s pants were pulled down below her buttox along with her brief. [WITNESS #1] stated that James said something about [VICTIM #1] losing an earring and then left the facility.

I then spoke with [WITNESS #2]. [WITNESS #2] also advised the same scenario as [WITNESS #1]. She stated that she walked into the room with [WITNESS #1] and observed James in the bed with [VICTIM #1]. [WITNESS #2] stated that James was lying behind [VICTIM #1] with his front up against her back. She stated that when she told [VICTIM #1] that she needed to get her ready for bed, James stated “I don’t give a damn what you want to do with [VICTIM #1].” [WITNESS #2] stated that she said “excuse me?” To James and he then noticed that they were in there and quickly began trying to get up. [WITNESS #2] stated that when he got up, he backed away from [VICTIM #1] in an odd way, moving his hips back first before getting all the way up. [WITNESS #2] stated that when he got off of the bed, his zipper to his pants was undone and he quickly zipped it up. She then noticed that [VICTIM #1] was trying to pull her pants up as they were pulled below her buttox along with her brief.

[WITNESS #1] and [WITNESS #2] stated that [VICTIM #1] is mostly non-verbal and has other medical conditions that make it difficult for her to get around or speak. I was then provided the information for [VICTIM #1]’s daughter, later identified as [WITNESS #3]. I then called [WITNESS #3] and spoke with her about the incident. [WITNESS #3] stated that she has power of attorney over [VICTIM #1]. She further explained that [VICTIM #1] had a brain injury and surgery on her brain. She also stated that [VICTIM #1] is mostly non-verbal, but can sometimes speak slowly and softly. I then asked [WITNESS #3] if he knew the male that was with [VICTIM #1]. [WITNESS #3] stated that the male’s name was James Jones and he was a family friend who had been visiting [VICTIM #1] every weekend since she was placed in the facility in September, 2024. [WITNESS #3] then gave consent to collect any evidence in [VICTIM #1]’s room and also wished to press charges against James if any crime was determined to have occurred.

Once detective Murray arrived on scene, employees and [VICTIM #1]’s granddaughter who was then determined that [VICTIM #1] would be to have an examination done to determine if she had been sexually assaulted.

I then went into room 207 with detective Murray. In the room, we collected the following evidence:

-Trash from the bedroom
-Trash from the bathroom
-Clothes from [VICTIM #1]
-Bed sheet
-Top sheet and blanket
-Bottom sheet
-Pillow case

I also collected a written statement from both [WITNESS #1] and [WITNESS #2]. The written statements and evidence collected from [VICTIM #1]’s room were then placed into evidence at the Dalton police department.

[VICTIM #1] was then transported to Hamilton medical center by EMS. The scene was then turned over to detective Murray.
