On May 31, 2026, at 2026 hours, Deputy Bandy was dispatched to 1200 Memorial Drive (Hamilton Medical Center) in reference to a female who advised medical staff that her husband assaulted her.

Deputy Bandy arrived on scene and began speaking with medical staff, who advised that a patient, [VICTIM #1], had shown up with several injuries. They advised [VICTIM #1] initially told them she had fallen before admitting that her husband, James Wilson, had gotten intoxicated and physically assaulted her.

Medical staff advised Deputy Bandy that [VICTIM #1] had advised that the physical abuse had been occurring occasionally for 16 years, and she had just never reported it. Medical staff advised that [VICTIM #1] was reluctant and scared for her and her kids’ safety, that James would hurt her if she spoke with anyone about it.

Deputy Bandy then entered the hospital room and observed that [VICTIM #1] had several bruises on her face that were consistent with someone being punched. Deputy Bandy observed that both [VICTIM #1]’s eyes were bruised and black, she had bruising under her chin, and she had a large bruise on the inside of her left arm. [VICTIM #1] also advised Deputy Bandy that her nose had been broken during the incident. Deputy Bandy asked [VICTIM #1] when the incident occurred, and she stated it occurred on May 29, 2026, sometime at night, at their residence located at [400 BLOCK] Grooms Drive.

[VICTIM #1] advised Deputy Bandy that James had been drinking alcoholic beverages when he had gotten upset with her about her not discussing things with him. [VICTIM #1] stated that James then began punching her in the face with his right hand and a closed fist multiple times. [VICTIM #1] stated she was bleeding from the face and had fallen to the ground. [VICTIM #1] stated that she was trying to get away from James, went outside, and he followed her.

[VICTIM #1] stated that while outside, James had begun punching her in the face again, and she had fallen to the ground. [VICTIM #1] stated that while she was on the ground, James began kicking her several times with his leg in her face, back, and legs. [VICTIM #1] stated that James then placed one of his hands around her throat and began strangling her. [VICTIM #1] stated that James then dragged her back into the residence.

[VICTIM #1] stated that she was still able to breathe but was scared for her safety when he was strangling her. [VICTIM #1] stated that she was also in fear for her safety when James was punching and kicking her. [VICTIM #1] stated that they have three children, Juvenile 1, Juvenile 2, and Juvenile 3, together; however, they did not witness this particular incident.

James and [VICTIM #1] are married and live at the residence where this occurred. While speaking with [VICTIM #1], Deputy Bandy observed that [VICTIM #1] appeared to be extremely scared that James was going to hurt her or her children again. [VICTIM #1] stated that the children have witnessed some of the physical domestic incidents in the past that were never reported. Deputy Bandy was notified by medical staff that [VICTIM #1]’s nose was confirmed broken and had a slight bend. Photos of [VICTIM #1]’s injuries were taken and will be uploaded to evidence.com.

Based on the testimonial and physical evidence, Deputy Bandy then applied for a warrant for James for violation of O.C.G.A 16-5-24 Aggravated Battery under the family violence act and violation of O.C.G.A 16-5-23.1 Battery under the family violence act. Deputy Bandy was granted warrant number W26-896 by Judge Griffin for the offenses listed above.

Deputy Avila, Deputy McKenzie, and Deputy Bandy then responded to the residence located at [400 BLOCK] Grooms Drive and made contact with James at the front door. Deputy Bandy read James his Miranda rights, which he advised he understood and that he wished to speak. Deputy Bandy asked James about the incident on May 29, 2026, and he advised that there was an argument between him and [VICTIM #1]. Deputy Bandy asked James if he had any alcoholic beverages that night, and he advised that he did.

James advised Deputy Bandy that [VICTIM #1] sustained an injury under her chin when she fell and hit the dog cage. James then advised [VICTIM #1] had fallen again while outside, and that was how she blacked her eye. Deputy Bandy asked James how her other eye had been bruised, and he said he was unsure. James advised Deputy Bandy that [VICTIM #1] falls often and advised that there was blood from her on the front porch of the residence. James then advised that he did not see [VICTIM #1] fall; that’s just what she told him happened. Based on Deputy Bandy’s observations of [VICTIM #1]’s injuries, they were not common for someone who had fallen.

Deputy Bandy then took James into custody by placing him into handcuffs, which were checked for fit and double locked. Deputy McKenzie responded to Hamilton Medical Center, picked up [VICTIM #1], and transported her back to the residence, where Juvenile 1 and Juvenile 2 were. Deputy Avila stood by with the two juveniles while Deputy Bandy transported James to the Whitfield County Jail and turned him over to Booking Staff without incident.

James was served with Warrant number W26-896 for violation of O.C.G.A. 16-5-24, Aggravated Battery (FVA), and O.C.G.A. 16-5-23.1, Battery (FVA).
